'Milkshake murderer' Nancy Kissel seeks fresh appeal in Hong Kong

HONG KONG -- An American woman convicted twice in Hong Kong of drugging her wealthy banker husband with a laced strawberry milkshake and bashing him to death wants to appeal her latest conviction.

The South China Morning Post newspaper, which requires readers to register, reported Friday that Nancy Kissel had applied for permission to appeal her conviction last year for the murder of Robert Kissel.


Kissel's lawyer previously said she was not going to appeal, but that she planned to ask to serve her sentence in the U.S., the AFP news agency reported.

 

However, a court spokeswoman confirmed to AFP Friday that Kissel, originally from Adrian, Mich., had recently sought permission to appeal her conviction.

Nancy Kissel, an American woman living in Hong Kong, was convicted of killing her investment banker husband by poisoning his milkshake. After winning an appeal, a second trial recently ended with another guilty verdict for Kissel, who insists she was a battered wife who acted in self-defense. TODAY's Jenna Wolfe speaks with Frank Shea, a key witness in the case, and criminal defense attorney Paul Callan.

"No date has been set for the hearing," a court spokeswoman told AFP.

'Adultery, violence, spying, greed'
Kissel's first trial in 2003 grabbed world headlines as it detailed the disintegration of the wealthy expatriate couple's marriage in the southern Chinese financial center.

AFP said the case had shone "a spotlight on Hong Kong's elite expatriate community, and featuring sensational allegations of a heady mix of adultery, violence, spying, greed and enormous wealth."

In March last year, a jury found her guilty at a retrial. She had denied murder, but admitted the lesser charge of manslaughter for causing his death.

She had testified her husband physically and sexually abused her.

Kissel must apply for permission to appeal because the 28-day deadline to file one following the trial in March has passed.

Robert Kissel's older brother, Andrew, was also murdered. He was found stabbed to death in 2006 in his Greenwich, Connecticut, mansion at the age of 46, three days before he was going to plead guilty in federal court to real estate fraud. His estranged wife, Hayley Wolff Kissel, did not attend the funeral.

Andrew and Rob Kissel shared more than blood. They each had the trappings of success; nice homes; wealth; luxury lifestyles. Who would want to kill either man, let alone both of them?

His death remains a mystery, although there has been speculation he planned his own murder, sacrificing himself so his family could benefit from his insurance policies.

The liberal progressives want to give your money to charity while keeping theirs safely ensconced in trust funds and off shore banks accounts. The taxes that Buffett (who hasn't even been paying the taxes his company currently owes) et al are asking for doesn't impact the wealthy, only those who are working to become wealthy. The doctors and business owners who are moderately successful will be hit by these higher taxes because they only tax INCOME, not wealth. Want to see how fast Buffett et al change their tunes? Demand a 40% annual property tax on all assets exceeding $15,000,000. Don't want to go that high? Ask them if they'd be willing to at least hand over 10% of their assets at the end of each year. They won't do it. Why? Because they KNOW that an increased INCOME tax rate won't impact them because they don't need to earn any income to live comfortably, they've got plenty in the bank. But if you require them to hand over a significant portion of their accumulated wealth, they'll scream bloody murder. An income tax doesn't impact the wealthy, it only impacts the workers. A property tax on high value estates hits the wealthy. Since Michael Moore has a net worth in excess of $50,000,000, he should be willing to cough up a few million for those poor occupiers don't you think? According to him, "Capitalism hasn't done anything for" him. I'm sure that Michael Moore wouldn't miss a meal if he had to forfeit all of his assets over $15 million.

    BTW the good rich Obamao and the evil rich Dick Cheney made roughly the same $4 million in 2008. Obamao donated less than $50,000 (less than 1%) to charity while Dick Cheney and his wife donated over $3 million (Over 75%) to charity. Who's really the evil one? The man who gives from his own pocket, or the one that steals at gunpoint (IRS agents carry firearms) from others, and uses the proceeds to pay his henchmen before giving anything to anyone else?

    I think you failed to mention that the 4Mi is only what they get as income, we are talking about investments, ventures, overseas bank accounts and special interest monies (lobbying) politicians don't declare as "income" and therefore is taxed differently or not taxed at all. I don't care whether is a republican, an independent or a democrat, taxes loopholes need to be eliminated. That is fair.

              Yes, get to know them real well. But after you do get married, treat your mate with ever lasting respect and love. Because the end result may be sucking your last meal from a straw. Many comments posted about the number of drug / poison laced deaths there are. Fact is, not so many. The real number of deaths caused by eating the wrong food like to much fatty beef, cakes / bread, milk products, deep fried foods, and to much booze.

I know immediatly when a woman gets charged with killing a spouse or boyfriend that card is always pulled. Its almost as bad as the "Black man did it" defense.               I agree. I get tired of hearing my female friends bitching about their boyfriends or husbands. If it's really that bad, they should leave. There is never an excuse for murder. But no, they stay with the guy and everyone is suppose to feel sorry for them. "I'm a victim." Whaa Whaa. They've volunteered and then they have kids that are in the middle of it.                 They won't leave, they are used to a certain status, some of then never worked in their lives and will not give up their lifestyles for anything. I never understood why these people don't divorce but after watching 48 hours Mystery and dateline for so long I've come to realize that their deal is to get as much money as possible (the wife) or to give as little money as possible (the husband). At the end it's the children who pay, dad is dead, mom is in jail kids go to either foster care and end up living with relatives. All this mess because greed and bad blood. Divorce seems like a much cheaper alternative, even if you end up having to -oh the horror- get a job and skip a few manicures here and there.

                            Convicted criminals should not get to appeal over and over again. When someone is found not guilty then evidence surfaces there is no retrial, I wish there was no double jeopardy people like OJ and CA who are guilty get away with murder because of stupid people on the jury so the state should also get to appeal sentences that go the other way.

                                  Seriously?...shes already been tried twice and found guilty both times. One of which she plead to manslaughter. She says she was abused?...ill probably catch flack for this but, GET A DIVORCE! he was wealthy as hell anyways she wouldve gotten half of it, but as an American that wasnt enough. she had to have her cake and eat it too by killing him

                                    why catch flack for being correct. what you said is pretty much true. as someone who worked in the system, i have heard most of the stories. i remember years ago, there were 2 women who tortured and maimed a guy under an overpass. they didnt kill him, but really messed him up good. they used the "i was abused as a child defense" they fortunately lost and got long prison terms
