Updated at 10:20 p.m. ET: GUANTANAMO BAY NAVAL BASE, Cuba -- Accused Sept. 11 mastermind Khalid Sheikh Mohammed and his co-defendants defied a military judge Saturday by refusing to answer his questions, and one of them got up and started praying as the long-awaited arraignment of the terror suspects got off to a rocky start in a military courtroom in Guantanamo.
Mohammed -- dressed in a white turban and robe -- sat silently, taking off his headphones when Judge James Pohl first addressed him. "One cannot refuse to participate and frustrate the proceedings," a clearly irritated Pohl snapped.
"The reason he's not putting the earphones in his ears is because of the torture that was done to him," his lawyer, David Nevin, told the judge.
Ramzi Binalshibh, another alleged 9/11 plotter, at one point disrupted the court by standing up and shouting -- first in Arabic and then in English -- that "the era of Gadhafi is over but it continues at this camp. Maybe you aren't going to see me anymore ... there are threats we have seen at this camp. Maybe they will kill us and say we have committed suicide."
When Pohl ordered him to sit down, saying such issues could be raised later, Binalshibh shot back: "The time to discuss these things is now, not tomorrow."
While families of the 9/11 victims watched in the courtroom, and on closed-circuit television at seven sites in the United States, the dispute - and other protests by the defendants and their lawyers -- appeared to initially tie up the proceedings in knots.
The chaotic hearing ended with the reading of the 87 pages of charges, which took more than two hours. The judge then declared the court in recess until June 12.
Binalshibh earlier brought the court to a halt when he stood up and then dropped to his knees in prayer.

Another defendant, Walid bin Attash, sat in court in restraints -- apparently because of a dispute with guards -- and his lawyer said he couldn't participate because his client was "in pain." The restraints were later removed.
With his long flowing beard, Mohammed was a striking presence in the courtroom. But his refusal to utter a word -- despite repeated entreaties by the judge -- stood in stark contrast to previous court appearances where he has chanted Koranic verses, denounced the United States, and taken credit for the terror attacks.

When the defendants declined to wear their headsets so they could listen to translations of the judge's questions, Pohl ordered a translator to repeat them out loud in Arabic. And he plowed ahead, asking each of the defendants detailed questions about their knowledge of the lawyers who had been appointed to represent them and whether they accepted them. None of the defendants responded and refused to even look at the judge.
During a break, the defendants could be seen leaning back in their seats, laughing, smiling and chatting among themselves -- apparently pleased with their ability to frustrate the judge.
The lawyers did their part, raising repeated objections. Cheryl Borman, a lawyer for Attash and dressed in a muslim hajib, objected to the attire of women members of the prosecution team, several of whom were dressed in military skirts with their legs showing.
"There are issues of cultural sensitivity here," she said. "I am suggesting the prosecution team make decisions of appropriate dress of their female colleagues so that our clients are not forced to look (at them) for fear of commiting a sin under their faith."
Nevin, Mohammed's lawyer, asked Pohl to force prosecutors to identify the men sitting in the back of the courtroom. "Given what Mr. Mohammed has been through with unknown, shadowy people it will affect his ability to proceed," Nevin said. The men were later ID'd as paralegals and FBI agents.
The tactics appeared designed to highlight objections their lawyers have raised to the fairness of the proceedings before a military commission.
In recent days, defense lawyers have filed motions objecting to rules that allow military guards to inspect the mail they send their clients, a lack of translators, and orders that make anything their clients as "presumptively classified."
The Obama administration had previously sought to try the suspects in federal court in New York City -- a move that stirred up a storm of political opposition. Since then, the case has been moved back to military court here at Guantanamo and some of the family members that gathered here this week said they are anxious to see the suspects brought to justice.
An online article purportedly written by al-Qaida members includes instructions on how to set fires in Montana. NBC's Brian Williams reports.
"I'm from Brooklyn and you know what, you face your, you face your fight," said Eddie Bracken, whose sister Lucy was killed in the World Trade Towers.
He said he wanted to see Mohammed and his co-defendants in the courtroom. "I want to see him eye to eye. That's the man that killed my sister -- him and the other cohorts or whatever you want to call them."

It was the first public appearance by the five men in more than three years.
Mohammed, a Pakistani citizen who grew up in Kuwait and attended college in Greensboro, N.C., was joined by four co-defendants:
- Binalshibh, a Yemeni -- allegedly chosen to be a hijacker but couldn't get a U.S. visa and ended up providing assistance such as finding flight schools;
- Attash, also from Yemen, allegedly ran an al-Qaida training camp in Afghanistan and researched flight simulators and timetables;
- Mustafa Ahmad al-Hawsawi, a Saudi accused of helping the hijackers with money, Western clothing, traveler's checks and credit cards;
- Ali Abd al-Aziz Ali, a Pakistani national and nephew of KSM, allegedly provided money to the hijackers.
Like Mohammed, Binalshibh also earlier told the court he was proud of the attacks in New York, Washington and Shanksville, Pa.
Defendants before military commissions typically do not enter a plea during arraignment. Lawyers for the men said they were prohibited by secrecy rules from disclosing the intentions of their clients.
Rachel Maddow points out that while fear and a lack of confidence in the American Justice system has forced terror trials like the upcoming trial of Khalid Sheikh Mohammed to be held at Guantanamo, prosecutors were able to conduct a successful terror conviction in a Brooklyn court without any of the dire consequences warned of by alarmists.
But Jim Harrington, Binalshibh's civilian lawyer, didn't expect any of the defendants to plead guilty, The Associated Press reported.
And attorney James Connell, who represents al-Aziz Ali, told reporters at the base that the arraignment is "only the beginning of a trial that will take years to complete, followed by years of appellate review."
"I can't imagine any scenario where this thing gets wrapped up in six months," he added.
Also in court Saturday were six 9/11 family members who won a lottery to attend the proceedings. Others were watching on closed-circuit video at military bases in New York City and the eastern U.S.
Cliff and Christina Russell traveled from New York to honor the memory of Cliff's younger brother, Stephen, a firefighter killed responding to the attacks, AP reported.
Cliff Russell said he hopes the tribunal will end with the death penalty for Mohammed and his co-defendants. "I'm not looking forward to ending someone else's life and taking satisfaction in it," he said. "but it's the most disgusting, hateful, awful thing I ever could think of if you think about what was perpetrated."

Let's see. We've held these men for close to 10 years, tortured them and now expect to have a "fair trial" based on evidence gathered from torture? On American soil no less (yes Gitmo is American soil). What they did was horrendous but so too was what our government has done. In a normal course of events the Supreme Court would never allow this to happen but as now mob rules so all bets are off. Be careful what you wish for because this could become the norm for American citizens. With such a perversion of our judical system and the trillions of dollars spent in Iraq and Afghanistan these people have already "won". How much more freedoms are you willing to sacrifice?

We own the base we own the jail in cuba. The expense is what it cost the U.S. right now. The guards are military service members. They get paid their normal military pay rate. It is not much expense for the Mess Seargent to fix 5 or so more meals to feed them. I think killing them could cause other extremist to start somthing, causing a lot more expense. This was done to the Nazi war criminals. If they are to be exicuted, you need someone from their religion to drop the trap door.

GITMO is not 'American soil', and since they are fighters against the US and not in uniform in a war declared by al Qaida, they can and should be shot as spies. That has been 'case law' throughout history.

Simply put, only a small handful of 4-5 of these prisoners had anything to do with the 911 attacks and these 4-5 should be tried as terrorist criminals. The other 164 should be released back to the countries they were rebelling in and let those countries prosecute them. Very few of these prisoners were fighting any form of threat against the U.S. They were captured simply because they were fighting for political power in Afghanistan, Pakistan etc. Let those countries take on the responsibility of these prisoners and send them back. The military does not need to rely on the civilian information derived from tortures to prosecute the remaining five. They already had what they needed to go after these terrorists before their capture and those evidences are not contaminated by anything the cia or any other organisation did or didn't do after their capture.

If the Afghanis, Saudis, Yemenis, Pakistanis decide to let the prisoners go after we ship them back then that is their problem to solve. 164 prisoners had nothing to do with 911 and quite frankly, if the people of the nations they came from do not choose to prosecute them for their crimes they committed in their countries, then I really don't care. Had we not been in Afghanistan to begin with toppling the Taliban from power in their own country, 911 would not have happened. This are criminals judging criminals. That's why Congress did not allow the FED to take them to court. If these men declared how they were tortured people would be shocked and might ask for the heads of the sadists that tortured them and the sadists that approved such measures. They are judging them behind close doors and will sentence them to death in a way that will not let any incriminating evidence to become public. Imagine if one of the accused declares something that demonstrates that there were people in our government involved in that attack.

Just adding my two cents to this, although I doubt anyone cares about having a logical discussion anymore. You cannot declare someone a terrorist while also proclaiming them to be an enemy combatant. If you claim someone is an enemy combatant that has engaged in open conflict with the United States, it's like saying that their attacks on our country were a legitimate act of war, not a crime. By charging them in military court, it makes it seem like Al-Qaeda is an established military force. It's not. It's a bunch of extremists running around and blowing up towers full of civilians. Charge them in a civilian court with 3000+ counts of murder, you get the death penalty. I'm sure of it. Charge them in a military court, you get justification for every horrific thing they've done. I personally agree that these people are the worst sorts of scum imaginable and should be lumped in with Hitler, Pol Pot, etc. I'm just giving you my take of it. Funny thing is that the ones who are disrupting now, admitted their involvement in 911 before they were tortured. They gave a lot more info after. Since they are admittedly war criminals just hang them or shoot them instead of this three ring circus we are in now trying to get a trial for them. I wouldn't be opposed to charging them in court, or under crimminal statutes; if the sentences are effective, and not more prone to being over-turned, or drawn out... I've heard some stats suggest that crimminal procedings have proven to stick through the appeals process much more so/less subject to overturning. If that's the case; I'd care more about effective results, then arguments wrt why they should/shouldn't be tried here or there....
Yes, perhaps many who are KNOWN to be terrorists should have been dealt with time ago, and in the course of military operations; but decisions were made to use for for intelligence purposes, and hold them. We brought them, well there.... And it would be natural to want to get the pound of flesh; though doing so could also risk making some martyers in the eyes of others. It might not always pay (immediately) to be more civil, but in the end we are also the ones who have to live with ourselves. tbh, I could care less if things were tried by firing squad, in civilian trial, or however; if we get the results.... It's the results (and whatever would give us results in trying and sentencing our attackers) which would matter the most. The "we don't want to try them this way, because...." gets into symantecs, IMO. If a charge will stick, and is less subject to appeal or overturning, so be it.... It might not fit within a certain sense of how we would chose to view them/not view them, but it would be pragmatic... If it means the Supreme Court or other high court can't over-turn convictions or order there release (or wouldn't be more likely to), then all the good.... If it means family can't come back latter and sue under civil suite or the like, bringing up some technicallity, very well then, and yes lets get this circus over with; along with whatever fallout some might want to bring up at a latter time. As long as it can bring an effective conclusion, that won't carry on into new trials, appeals, or what have you, I'm for it at this point....
As to these people disrupting the procedings, they're lucky we aren't an Arab country; or under Sharia law they might find their tongues cut out, or worse.... The trial is for their benefit though; and if in the end they chose not to cooperate, it doesn't take cooperation necessarily to find one in contempt of court, obstructing justice, and might there be grounds to then make summary judgement against them, based on other evidence? Finding their refusal to defend themselves as a choice made, and not nullifying of other evidence which is at hand?
If they continue to disrupt proceddings, just find them guilty. After all, they admitted it. Take them from the courthouse to the firing squad.

You need to work on your 'timeline'. We were in Afghanistan AFTER 9/11, and only because the Taliban was giving sanctuary to bin Laden after the attack of 911.

While I agree the timeline is not necessarily correct, President Clinton ordered a cruise missile attack on Afghanistan in I think 1998, but missed the targets. I think some could argue that was a provocation of war that could have brought about the 9/11 attacks. I know that was retaliation for another event, I think the USS Cole, which was a retaliation for another, and another, and so on.

The USA assisted the Afghan's with the overthrow of the then occupying Soviets. We trained Osama bin laden. His thanks was to, well you know how he thanked us. It was discovered that Al-quida had training camps inside Afghanistan. We had, as we do with all the nations from this region, a tenuous relationship with Afghanistan. When the Taliban, the governing body of that country refused to shut them down we did it for them. Now we still have this mess on our hands. Why do the victims and relatives want to see this radical Islamic gong show? At the very least they should be sequestered (the "defendants") in a separate room as they no doubt intend(ed) to use this trial to grandstand their skewed beliefs and surely the victims will find this charade difficult. It's easy to respond with anger to the defendants' behavior in the court room. There is no point in anger? The image of a serious prosecution combined with a serious judge dealing with a bunch of non-serious defendants is an image I find distasteful. I think if the defendants can laugh at all this, then the prosecution should do the same. If defendants are jumping around, then put them in leg irons for their own good and safety. Loud and disruptive, the put those acting like that in an adjoining room with video so they can watch if they like, sleep or pray or whatever. If non-free people choose to operate as they have, there simply is no point to anyone else getting their blood pressure up over it. I see no prospect of this trial being conducted with ordinary courtroom decorum and those trying to implement that will be frustrated.

1) I agree almost every President would have said take him out - I do question what Carter would have said.
2) Tell the defense lawyers that it is an American Military court of law and it will be conducted as one. So the female members of the legal staff will be in approved military uniform. If their clients don't like it then they can ask to be tried in absentia. Or just put them all back in their cages and tell them when they are ready to participate in the trial - we may start again.

I see MSNBC as well as other news outlets refer to them as "alleged" 911 Conspirators. What's the point? The full weight of the US government has already convicted them based on coerced confessions. Using the term alleged in the light of the outrage of what a joke this so called legal proceeding is a joke in and of itself. Is MSNBC concerned that by not using the term "alleged" that they will be held to some kind of legal liability? And if so, by whom? Plain and simple, nobody in Gitmo has any rights and using the term alleged or not using it, makes absolutely no difference whatsoever. Just say they did it, and say it before this so called trial.
