GENEVA - Syrian government forces and allied shabbiha militia have committed war crimes and crimes against humanity, including murder and torture, United Nations human rights investigators said on Wednesday.
Syrian rebels fighting to topple President Bashar Assad have also committed war crimes, including murder, extrajudicial killings and torture, but the violations "did not reach the gravity, frequency and scale" of those carried out by the army and security forces, investigators concluded.
U.S. officials say that dozens of people, including children, were killed by Syrian government forces in the central town of Houla. NBC's Richard Engel reports. Warning: Some of the images are disturbing.
"The commission found reasonable grounds to believe that government forces and the shabbiha had committed the crimes against humanity of murder and of torture, war crimes and gross violations of international human rights law and international humanitarian law, including unlawful killing, torture, arbitrary arrest and detention, sexual violence, indiscriminate attack, pillaging and destruction of property," said the 102-page report by the independent investigators led by Paulo Pinheiro.

The shabiha are largely Alawite, the Shiite group that Assad and most of his inner circle hail from, and are accused of carrying out killings of Sunnis and opposition activists.
Alex Thomson, reporting for NBC News has the first report from inside the Syrian town of Houla where more than a hundred people were massacred, nearly half of them children. Villagers, eager to tell their stories, said they were attacked by pro-government Shiite and Alawite militia. The Syrian government claims the massacre was the work of terrorists.
The U.N. panel appointed by the U.N.'s 47-nation Human Rights Council blamed the government and allied militia for the killing of more than 100 civilians in the village of Houla in May, nearly half of them children, and said the murders, unlawful killing, torture, sexual violence and indiscriminate attacks "indicate the involvement at the highest levels of the armed and security forcesand the government."

The report covers the period between Feb. 15 and July 20 andinvolved 1,062 interviews, both in the field and in Geneva. But the panel members emphasized their lack of ability to carry out theirU.N. mandate within Syria hampered their investigation.
Activists say more than 20,000 people have been killed since thestart of Syria's revolt, inspired by other Arab Spring uprisings against autocratic regimes in the region.

The conflict has slowly changed into a full blown civil war that the panel says involves "more brutal tactics and new military capabilities on both sides."
Karen AbuZayd, an American expert serving as senior investigator alongside Pinheiro, told Reuters: "We have identified both parties as guilty of war crimes and of course a greater number and of bigger variety from the government side.

"What happened on the government side appears to be a policy of the state. It is not just widespread but similar large-scale complex operations, how they are carried out, the way the military and security work together," she said.
The investigators said they would update their confidential list of suspects or units responsible for violations and hand it over to U.N. rights boss Navi Pillay next month.

OK. I understand how it works now. The rebels have to reach a certain limit before they are as guilty as Assad's forces. Innocent victims are more than numbers in my book.

Assad started the killings against unarmed protesters aiming to win their freedom from what can be correctly called "Assad the Butcher. Thousands of syria's citizens had been killed before the civil war broke out, where former Assad's forces disgusted with the slaughter of their own people sided with the freedom fighters
Sichuan, who cares which side committed war crimes or both? The main question to ask the UN is who (or which country(ies)) is going to get theses war criminals? The US needs to stand back and let the other UN members start pulling their own weight.
So let's get this straight. The UN bozo's have concluded that both sides likely committed war crimes. They should acknowledge that what's going on in Syria is a civil war and keep the hell out of it. Who appointed this politically driven and ineffectual and corrupt outfit as the policemen of the world?
The only reason US supports the rebels is because US and Israel would rather have a weak and unstable, Lebanon like Syria, than stable Syria aligned with Iran. So that is why we support a movement full of common criminals and terrorists...
The west needs to stay the hell out of this. These rebels are nothing more than Islamists who want control for themselves. They do not want a free and open democratic society in Syria, they want one run under their perverted view of Islam where anyone who does not comply is persecuted and either "disappeared," or just killed outright. These rebels are not freedom fighters and this conflict is not about freedom. This conflict is about which group gets to control the country and repress everyone else. I for one would rather have a secular dictator than an Islamist one. In addition, it appear that the UN investigators have bought into the rebel's BS. There were very strong indications that the Houla massacre was actually carried out by the rebels and set up to look like it was done by Assad's forces in order to try and garner sympathy and support for these so-called rebels. It is without doubt that these rebels are perfectly capable of doing something like this in order to try and sway world opinion. The US and the rest of the western nations need to stay out of this conflict and let the people fight it out among themselves. This is a civil war and should be resolved by the people of Syria, not through outside interference. Outside interference has already handed Egypt and Libya over to the Islamists, it is time that the west woke up and recognized these rebels for what they are and stayed out of these conflicts. The Arab Spring has turned into more of an Arab Winter and nothing should be done to help or promote more of these uprisings.
I've said it before and will say it again. For hundreds and hundreds of years the conflicts have gone on in the Middle East. One group rules, kills, and does pretty much whatever they want until another group rises up with their own army and destroys them so they can take over. They eventually do the same killings, rapes, and torture as the ones they overthru. Been that way forever and shows no chance that it will ever change from these backwards people as they can't or won't enter the modern world.

Indeed politics as usual. One is also forced to wonder about a recent war with a country, which did not attack anyone and did not have WMD's, and was thus was a war of aggression? As I recall the Nuremburg finding was that a war of aggression was determined to be the ultimate war crime. Perhaps one only has an atrocity if one can comprehend the number of bodies - when the body count gets above a hundred thousand or more it is no longer an atrocity - as in that case. This just to more clearly delineate the profound hypocrisy and absurdity inherent in trying to define acceptable 'torture', acceptable 'war crime' and so on. If we wish to eliminate this abomination from human actions we need to have a simple exclusion which is rigorously applied across the board - and that means investigating and punishing past and current very questionable actions which are unpleasantly close to home. You cannot pick and choose.

Mickey gave a very good response and suffice it to say that the formation of the organization was in response to the question, "What if?"The world was still reeling from the world war that began with Nationalism and huge military buildups in Europe and Asia. What if Hitler could have been stopped after the invasion of Poland and Chezklovockia, and What if Japan were stopped as they savagely raped and murdered million's in China in 1937-8?
The concept is good, but the reality is that the members of the organization use their individual political interest to divide the organization and make it useless as a military force. Syria is a good example. Russia and China block efforts to move in to restore order, but the cost of allowing inaction from the superpowers is to allow the Biological and Chemical weapons to get into the hands of Religious fanatic's that will hold the world hostage or worse.
If you want a preview of things to come look at the Pandemic of 1918 where the Spanish flu killed millions of the world population. In America, I believe the total numbered around 1 million. Most seem to be moderate, but when the radicals openly kill their own on the Internet and say (Yes we Can:), the message is clear to all that they will kill anyone who opposes them.There is also a minority of christians there whao ar going ask if survival is an option or not.
Were it possible for China and Russia to overcome their need for personal greed, we could allow NATO and the UN to enter with force and pull the teeth of all combatants. But since that is not possible, we will wait and see whether we need to acquire gas mask or not.

In the last day, we have met three rebel commanders. One was an air-conditioner repairman before the war. and a tomato and zucchini farmer. The third grew grain and lentils. One of the commanders considers himself an Islamist. The other two are more secular.
In total, the three commanders control about 1,500 men. Not one of the commanders supports al-Qaida, nor have any of the dozens rebels have we have met. Some reports that al-Qaida fighters had recently taken over the Baab al-Howa border crossing. There was a video that showed rebels carrying an all black flag, similar to ones favored by al-Qaida. We spoke with the rebel leader who carried the flag. He said he has nothing to do with al-Qaida and the flag was an Islamic one.

This morning it was reported that Iran, as well as Russia of course, are teamed up helping Assad with weapons, training, logistics and funds. Iran is terrified that Assad's fall will spell the end of the dictatorship in Iran. Hizbolah has been penetrating the border into Syria in support of the military, and Turkey just stopped a weapons shipment fom Iran to Syria.
My take? Syria will fall into hands of AlQaida (not before considerable bloodshed) and Iranians will re-start their revolution of 2009.

War crimes occur on every side in every war. But not by everyone on every side. Robert Macnamerra has said that had the U.S. lost the war, they would have been charged with war crimes for indiscriminate bombing of Japanese and German Cities. Many German commanders, Incuding Erwin Rommel, were aquited of charges at the end of the war. Even durring the revolution Loyalists and Patriots did horrible things to civilians. Being Muslim has nothing to do with any of those crimes or the ones happening in Syria now.

The real atrocities are going to come whan Assad falls. His group of Shiite Alawites are about 10% of the population while over 80% are Sunnis. When a small minority brutalizes and controls a large majority, the paybacks are always hell, especially when the regime is as brutal as that of the Assads. Who are really going to suffer are the tiny minority of Christians who, decades ago, threw in their lot with the Alawites. They helped to britalize the Sunni majority and they will get the most severe paybacks. They knew Assad was a snake all along and it was in his nature to be a snake. But the Christians chose to be a snake.
And Sunni Syrians are much more likely to be like Sunni Turks --- very secular and not particularly religious, let alone radical Islamists. But in recent years, Assad's people have literally been driving them toward this civil war as they tortured and imprisoned tens of thousands and killed thousands more.
Assad will lose this civil war for exactly the same reason the south lost our Civil War --- no money for arms and a war of attrition that they can never win.
You are correct in that majority of Syrians are secular, but in desperation they are accepting help, military and funds, from AlQaida. Help does not come with no strings attached.
Don't be fooled by the illusion that Syria is a cohesive country. The Alawites can withdraw into a small section of the country and make it their own. The Sunnis will simply take over the rest of the country, and the Alawites will be assisted by Iran and Russia, who have vital interests in having a foot along the Meditarranean coast. They can hold out for quite a long time, so chances are that if the rest of the country is ceded to the Sunnis, the Sunnis will not have the fight in them to face death simply to finish off Assad and his supporters. On the other hand, with Iran's and Russia's support Assad could well defeat the Sunnis and then be a staunch ally for them, including letting Iran establish a military presence in Syria.
I would not be surprised to see Iran or Russia provide military forces to support Assad. Russia already has a base there, and could use the effort to show that the U.S. is not the only military power on earth. Obama would be in a pickle, because he could not risk a war with Russia, especially where Russia already has established a military base and has reason to prevent it from being attacked by the insurgents.
So? Barack Obama was complicit in the UN bombings and air strikes that killed civilians in Libya. Why weren't those war crimes? Even NATO is not justified in targeting innocent women and children, yet their excuse was that they thought they were targeting command and control facilities. I think they were trying to terrorize the government supporting population.
Even today Obama is conducting predator drone strikes in Pakistan and Yemen, killing people who are not combatants, but merely "suspected" terrorists. (Sounds a lot like Bashar Assad's claims, doesn't it?) Those suspected terrorists included Pakistani soldiers and unarmed teenage children, including one American citizen. Why aren't those called "war crimes"? Oh that's right, because we aren't at war with Pakistan or Yemen, so they are merely crimes against humanity, and since Obama is ordering these killings, they must be, to quote our President, "the right thing to do." We can only hope that once Obama loses the immunity from prosecution that comes with being president, he will be prosecuted in the World Court or elsewhere for his murders.
