Guantanamo detainee found dead, Navy investigating

Despite President Obama's vow to shut down Guantanamo Bay, the nation's most expensive prison is undergoing some costly new updates that would allow the facility to remain open for years. NBC's Michael Isikoff reports.

A Guantanamo detainee who died Saturday was a former hunger striker who had recently been placed in a disciplinary cell after splashing a guard with a "cocktail"-- typically containing urine, a U.S. military official tells NBC News. 

The Naval Criminal Investigative Service is investigating the death of the detainee, whose identity and country of origin will not be released until his family is notified, said Navy Capt. Robert Durand, a spokesman for the U.S. detention facility.

But Durand provided some new details about the detainee's death -- the ninth to occur at Guantanamo since the prison opened in early 2002 and the first since an Afghan prisoner committed suicide in May of last year.


The detainee was found unconscious in his cell in Camp 5 on Saturday afternoon and was taken to the Naval hospital at Guantanamo where efforts to revive him failed. There were no cuts on his wrist or any other obvious signs of self-inflicted wounds, Durand said.

The detainee also had no serious medical problems. He had participated in a hunger strike last spring but ended it in June and was examined as recently as Aug. 22 when he was at 95 percent of his body weight, Durand said.

He had "fairly recently" thrown the "cocktail" at a prison guard, causing him to be placed in a solitary cell at Camp 5, said Durand. 

Although the death occurred on Saturday, military officials did not announce it until Monday in order to give officials time to notify the host country and family members of the detainee. That process has not yet been completed, but officials decided to release some details Monday because of concerns that some visitors to the base-- such as defense lawyers -- would learn about it anyway, Durand said.

The Miami Herald reported that a pathology and mortuary team was brought to the base on Sunday to attend to the body. A Muslim imam was summoned in order to give the man Islamic rites.

The dead man’s remains will be returned home after an autopsy, the Navy said.

The detention camp was set up to hold non-American captives suspected of involvement with al-Qaida, the Taliban or other Islamic militant groups after the September 11, 2001, attacks. Of the 779 men held there, 167 remain.

Keep drinking that Kool Aid. The OVERWHELMING majority of Gitmo detainees are completely innocent of any crime or any conspiracy to commit crime. Some genius in the Bush administration thought it might be a good idea to offer a bounty ($10,000) for the reporting of terrorists. Guess what happened? People called and reported any fool they hated (and got the money). Those people were locked up immediately, no trial, no lawyer. They can claim until their faces are blue that they don't know anything about anything, but who's gonna believe them? They are terrorist right?

There are numerous detainees who have been found innocent by a very partial judge (not partial to them), but to save embarrassment, they have not all been released and continue to be held and there is nothing anyone can do about it. It won't be surprising if suicide is viewed as the only way out.

I just read a news story about how Mexican drug cartels are sending 100's of tons of cocaine to the US with small submarines they built. You would think that because it's so easy to enter the US by foot through the Mexican border and so easy to deliver men and material with these subs, the US would have suffered a whole bunch of terror attacks since 9/11. But that's not the case.

So who, exatly, is the US holding and torturing at Guantanamo? They're probably people who saw a foreign soldier in their hometown and reacted a bit too strongly about it. Foreign soldiers who don't even know what they're looking for. These soldiers only know they're upset about some Osama Bin Something. These soldiers and the Congresspeople who sent them to war are so irrational they're killing and incarcerating anyone who doesn't like their presence in their country.

It's about time the US grows up and get real about the "enemy" they're fighting.

Reading these posts from people who have no clue about who these prisoners really are and whether or not they are guilty of anything, sounds like the same type of individuals we read about who called for the crucifixion of the man, Jesus, just because he was arrested by the government and the uninformed believed the government and demanded blood.

Some trials have been held. Some of them have been found innocent of any charges. Many of these 'terrorists' are political dissidents in their own country, whose only crime was to not believe whatever the current ruler-in-power believed. When the US asked the world at large to give them terrorists who might have been connected with 9/11, they got a lot of people whose government simply didn't want anymore.

Problem is that no one wants them here. Even if they are innocent, the assumption is that if you were in Guantanamo, then you're a terrorist. So even if they are innocent of any crime or conspiracy to commit a crime against America and its citizens, their country refuses to accept them back, and we can't let them stay. We can't execute them, because they are innocent. And so, because of this stalemate, there's nowhere for them to go. And because no one can figure this out, they have no options except lifelong indefinite detention, with no possibility of parole, freedom, or ever seeing their families again.

The other obstacle to closing Guantanamo is that it is a military base. We have soldiers stationed there, and its strategically placed to keep an eye on Castro and Cuba. Even if you could close the prison, you're not going to close the base without a Congressional order.

Not to mention which, there may soon be more detainees. There's a bill called the Enemy Expatriation Act currently coming up through Congress that will give the government the ability to strip citizenship from any American, naturalized or natural-born, who is suspected of advocating or supporting terrorism, and once their citizenship is stripped they can be subject to indefinite detention at Guantanamo without charge or trial as an 'illegal terrorist' per the terms of the NDAA for FY2012.

And Homeland Security's definition of 'terrorist' includes alternate media, animal rights activists, black power groups, white power groups, and members of certain religious sects like the Christian Identity movement and Odinists (those who worship the Norse God Odin.) Also included are those who stockpile weapons, those who stockpile food (more than seven days worth of food) anti-technology advocates, lawful acts of civil disobedience, hacktivists, and secondary and tertiary targeting (you bank with a bank that is suspected of laundering money for terrorists.)

SO--The Founding Fathers", in all their divine wisdom, denied over 50% of citizens the vote. They approved of slavery and genocide against the indigenous people , etc.. Madison, in his own words said that the voice of the citizenry should be minimized, as they were too ignorant to participate. Only an elite few were fit to govern. He also believed that the average person was here to serve those of higher statute. They fathered children with the slaves they "owned." The Constitution is just a knock off from the writings of Voltaire combined with British Common Law.

The Founding Fathers were just as big of amoral pricks as we have in office now---and the exclusion from these ranks are Liberals. Give me someone like Bernie Sanders, Russ Feingold, or Elizabeth Warren over the leaches in either party.

I know you don't want to believe this but President Obama just spent 169 million dollars in up grades to Gitmo...that is right he did it and it was reported here on MSMBC the expense is the equivalent of $800,000.00 per detainee. My only thought was wouldn't the money have been better spent giving returning veterans some cash to survive the first few months of unemployment again courtesy of the Democrats and President Obama? Part of the upgrade included a new $750,000 soccer field, cable TV, air conditioning and Internet. They are now living better than the ground pounders that arrested them in the first place. Your views while somewhat high minded given the individuals who reside in Gitmo are very naive. These guys would behead you just because you claim to be American. These same individuals had involvement in 9/11/01 and you would give them a pass. They would give you death.

The HR 3166 and its similar to the Senate S 1698 , both have only 3% chance to move foward , because it has too much opposition in both sides. It was President Barack Obama , no Bush or any other Republican to make it clear , to the liberals in this forum, who signed the National Defense Authorization Act (NDAA) into law despite public approval ratings as low as 2% (The NDAA gives the administration the right to indefinitely detain, without charges or trial, anyone it deems to be a terrorists threat.) But whether American citizens—who are guaranteed due process of law by their Bill of Rights—were included in the authority of the NDAA was not made absolutely clear.

In the Presidents defense he made a promise without the knowledge he gained in his first meeting with the Joint Chiefs. After that meeting his view of the world was highly modified in comparison to the political promises. If not how do you think Hillary Clinton extended our engagement in Afghanistan to 14 more years? The same thing happened to every President way back. Some Presidents had the temerity to go their own way and most of them did not. If you think it was any different with President Bush you are mistaken. I have met people who worked on the battle plan for Iraq when Clinton was still President. I have met people who worked logistics on the battle plans years before the first soldier moved a muscle. If you think you can move all the man power, machinery, and support services in a few days you are quite mistaken. It took months of build up and prep work and years to plan. I met someone who did the ground work on disease our troops would face in Vietnam years before the first troops arrived. The military has a plan and works the plan...at least 5 years in advance or more. I don't care who the next President is day one with the Joint Chiefs will take their breath away.

No I won't give sources...some are still active military and others...shall we say are professionals.

In any action people have to adapt to change. This is true in business and in life. The Humvee was the problem not the tanks. The Humvee was replaced by heavy armored trucks and even then IED's created problems for our military. No force in history has ever been totaly ready for what it faces in war...it has to learn and adapt or perish. Did the forces run our of gas, spare parts, cloths, food, drink, munitions or quarters...that is the main part of logistics...never leave your supplies behind or allow them to be cut off.

US Customs and Immigration Services, Customs and Border Protection, Federal Emergency Management Association, Immigration and Customs Enforcement, Transportation Security Administration, the US Coast Guard, the National Communications Center, the National Cyber Security Center and the Office of Civil Rights and Civil Liberties are now included under their umbrella. The Secret Service, who used to be a branch of the Treasury, was transferred to Homeland Security control too.

So knowing that, how willing is the President going to be to set himself against something that Homeland Security wants when they are the same ones tasked with protecting and defending his wife and children? How easy would it be for something to happen, especially given what's been publicized lately about the behavior of some Secret Service agents? And I'm sure we've all noticed the almost total media blackout on the topic--the only places where you can find articles and discussions of the thing are on Huffington Post and other alternate media sites--which, according to the list in post 1.32 above, is now on the watch list. Many people are still not aware of the NDAA for FY2012--and its ramifications for the people.

But whether American citizens—who are guaranteed due process of law by their Bill of Rights—were included in the authority of the NDAA was not made absolutely clear.

Actually, the Constitution says 'No person shall be denied life liberty or property without due process of law.' It doesn't make the distinction between citizen or noncitizen, illegal or undocumented. It simply says 'No person'.

In the version of the NDAA for FY2012 that was eventually signed Dec 31, 2011, it specifies mandatory detention without charge or trial for any non-US citizen suspected (not proven) of terrorism or supporting terrorism. For US citizens it said the indefinite detention would be 'discretionary', not 'mandatory' but it did not say who would be making that discretionary determination.

And the reason all this stuff is getting passed is because of money. For every person Homeland Security detains, whether it be child, illegal, undocumented, citizen, or non-citizen suspected terrorist, they ask Congress for $141 per person per night, roughly $51,465 per year. Let's use immigration detainees, since that's who the bulk of the money is for--detention of immigration detainees until decision/deportation (and even after someone has proven they are a citizen, Homeland Security still continues to hold them.)

A private, for-profit prison will hold that immigration detainee in their private prison for Homeland Security for between $40-$98 a night. That's $14,600 -$35,000 a year, and Homeland Security keeps the extra $15,000-$36,000 a year to add to their budget. The private prison system cuts corners with detainees and pours money into lobbyists, who wine and dine lawmakers and congressmembers to get them to vote favorably on a specific bill that will keep the supply of detainees--and thus the money--coming.

In the meantime Homeland Security takes their part of the money and pours it into projects like the development of scanning surveillance systems that can see through walls (Xaver 800 Through Wall Imaging System) portable DNA analyzers, and behavior-assessment computer programs like the one they are testing at Boston's airport right now that determines if someone needs to go through extra security--based on pulse rate, heartbeat, respiration, perspiration, shifting eyes, and other biophysical factors, the person may be about to commit a terrorist act.

    On January 22, 2009 as one of his first official acts in office, Barack Obama signed an executive order to close GITMO within one year. On that day Obama said, “This is me following through on not just a commitment I made during the campaign, but I think an understanding that dates back to our founding fathers, that we are willing to observe core standards of conduct, not just when it’s easy, but also when it’s hard.

    In May 2009 only 6 Senate Democrats voted NO on the amendment to, “To prohibit funding to transfer, release, or incarcerate detainees detained at Guantanamo Bay, Cuba, to or within the United States.”

    Progressive heroes Chuck Schumer, Byron Dorgan, and Russ Feingold all sided with the Republican minority and voted to deny Obama the funding that he needed to close GITMO and relocate the detainees. Only six Democrats stood with the president on closing GITMO, Durbin, Harkin, Reed, Levin, Leahy, and Whitehouse.

      Actually Illinois wanted it, but Rep. Frank Wolf (R-VA) scuttled the plans. Wolf sits on the House appropriations committee and is the chair of the spending subcommittee that controls the Justice Department budget.

          I've done extensive reading about GITMO. The U.S. army are liars. They set up a special part of the prison to look fancy, so it seems the prisoners are getting special treatment. It's not true. It's not where they're housed; it's a sham. If you did some research, you would see that it is all a lie, just a ploy to keep innocent people behind bars and to make them look guilty, so the military can say they're doing something right. Also in the documentation of the so-called "suicides", the prisoners' hands are tied behind their backs. Tell me, how do you do that AND hang yourself at the same time? And why? It sure would make it pretty tricky. U.S. Army=about as bad as the Taliban. And they're liars.

          The first mistake we made was to take these terrorists alive.... the second was putting them at Gitmo, the third is not spending the cost of a single bullet to allow them to join their allah and his virgin boys. A Korean colonel told me in 1964 that we would lose the war in Vietnam because we would not fight it the way the VC were fighting it.... he was right. We will lose the war against the Islamists for the same reason. You fight fire with fire and let God sort out the bodies later. I took more bamboo sticks out of GI feet that were dipped in dung, tried to reconstruct blown apart young men who tried to help a wounded Cong that was booby-trapped than I can remember.... am I bitter, you bet.... send all of the terrorists AND anyone who supports them to the same hell.                           NONE of us know if they are ALL guilty. Obama tried like hell to close bush's hell hole but was blocked by the GOP. Also blocked trials in the US. I want the place closed, these people given trials and turn loose of those that we have no evidence against to prove they are guilty! A family lost someone in a far away prison and that is awful, no matter what religion they hold. Hell, I don't trust the guards at Gitmo so don't think their treatment is as well as you all pretend or think. They are still away from family and country for idiotic beliefs but we would be labeled the same if we were prisoners in their country. We DID invade so I know how pissed I'd be. No, I have no sympathy for those that did actually commit the crimes or harmed any US CITIZEN but it is a shameful way for us to act. All of you whinny aholes, let's give them a trial (much quicker and would have been done with if the GOP hadn't lied about it) in the US and get them the hell where they belong. Send home the innocent or those not proven guilty (there is a DIFFERENCE)! Close this damn place and all of you stop acting like terrorists wanting all dead!!!! God, we aren't any better than the terrorists in the prison! A FAIR TRIAL, that is the way of the UNITED STATES or suppose to be.                           As for the GOP being involved the Democrats were in FULL POWER the first full year of Obama's presidency and nothing was done. So don't blame the republicans for it.

                          People charged with terrorism have no rights. These aren't poor misunderstood American Criminals. These are people charged with 9/11 attack and other acts of terrorism.

                          The GOP has abused the filibuster a record number of times, making 60 votes a requirement to pass anything in the Senate.

                          The Democrats had that 60-vote margin for a total of 24 days from 2008 to 2010. Because either Teddy Kennedy or Robert Byrd was out sick or had died, or there was an unfilled seat due to special elections, slow vote counts (Minnesota), etc.
