A U.S. Border Patrol agent fatally shot a young Mexican man who had fled across the border into Mexico, the agency said.
The Border Patrol issued a statement Thursday saying that agents responded around 11:30 p.m. Wednesday to reports of two suspected drug smugglers on the U.S. side of the border in Nogales, Ariz.
The agents reported seeing the men “drop a narcotics load” on the U.S. side of the border before jumping a wall or a fence to flee into Mexico.
Once in Mexico, according to the Border Patrol account, the men started throwing rocks at the agents. When they refused to stop, “one agent discharged his service firearm.”
Field supervisors have been ordered by Washington officials to downplay the smuggling threats, a former DEA supervisor says – a charge U.S. Customs and Border Protection vehemently denies. NBC's Mark Potter reports.
“One of the subjects appeared to have been hit,” the Border Patrol statement says. Border Patrol immediately notified the Mexican government; on the U.S. side, the investigation into the shooting is being led by the FBI.
The man was hit 10 times from behind, a doctor in the area told Telemundo. Municipal and state investigative police also said the man was shot several times. They said they found the man, in his mid-20s or early 30s, lying on his stomach.
The man was about 32 feet -- about the length of a yellow school bus -- from the international line when he was shot, Telemundo reported.
About 5,200 Border Patrol agents patrol the Arizona border with Mexico, spokesman Victor Brabble said. That’s 859 more agents than in 2010, representing the Obama administration’s commitment to adding more agents to the border.

This incident, while being funny to some, and way overdue to others, brings into question the use of deadly force when no agents lives were in danger. If deadly force can be used when no one is in danger, then what is the limit on the use of deadly force against illegals and legals?
It is the process that must be understood and clearly followed. In this case, it seems the process for allowing the use of deadly force is either missing, incoherent, or not being followed. This is not a football game where everyone goes to the showers and gets a good night's sleep after the game. A man is now dead. Deadly force was used when not needed. I take now joy in the loss of life. Not even a drug mule, especially if the drug mule was not threatening the lives of the agents. This was not a smart thing to do.

Who is really responsible for the drugs coming into our country? The drug mules? The dealers that live here that buyy what the mules deliver? Or the users that buy from the dealers?

@Glenn & Johnny, stoning is a way of killing someone. The story does not say what size rocks were thrown. Toss a pebble up and let it hit you, have a friend throw a rock at you. Do it enough and your going to have bruises and if it hits wrong, you can loose conciousness, or die. I live a 20 minute trolley ride from the border and visit Mexico quite alot. As you enter Mexico, stationed there are Mexican Marines with automatic weapons, which I'm sure they won't hesitate to use if needed.
That being said, If 2 men running back into Mexico want to stop running after they hit the border and start throwing rocks, you don't bring a rock to a gun fight,you keep running. Dumb a$$es.

I'm thinking back to the farmer along the border who was threatened with death by the cartel if he harvested his field. They needed the cover his crops offer to hide their drug drops. He lost the biggest part of his crop because he didn't get it harvested in time. If it had been my farm, I'd have waited til after dark and used a crop duster to pour gasoline on the crop and then struck a match.

Couple of thoughts here...
1. Horray, at least it wasn't a border patrol agent as a result of Fast and Furious Executive Priviledge 2, the sequel.
2. I couldn't agree more with the sentiment to extend capital punishment to drug users. A vast majority of crimes in this country are the result of drug addiction, booze addiction or gambling addiction. In fact, I would even love to extend capital punishment to any and all sex offenders, again these perverts have shown time and time again they prey on children, women, and the elderly/infirm.
3. Perhaps if more incidents like this occurred, where our border agents actually took out the trash and made the illegal border crossings more dangerous than they are worth, perhaps that border might actually mean something other than the finish line to the land of milk and honey and social assistance.
4. It amazes me there are actually American Citizens that would even flap thier faces over the defense of OUR Borders. It don't make a bit of damned difference if it was a drug dealer, a human trafficker, or even an immigrant fruit picker. That BORDER is our front door. There were other ways to handle this without discharging a firearm several times and shooting the suspect in the back. Let's see what both countries investigation decides on this one. I doubt the agent was standing right on the line, so probably they were 50 feet from each other and the person throwing the rocks was in another country. The object had been achieved - the drugs did not make it into the US. The agent could simply have not engaged in the use of deadly force and left the area.
You know......Mexico never formally signed a peace agreement after it declared war against Germany in 1942, so Mexico could receive brand new weapons for its military from the US. Since Germany is now a member of NATO, just like the United States, why doesn't NATO defend Germany against evil Mexico?

First off- Americans aren't sneaking into Mexico, smuggling people and drugs, and then cowardly throwing rocks at Mexican authorities from the American side of the border. The notion of just "simply walking away" from someone that just crossed the border illegally and IGNORING the fact they are assaulting you is not only assinine but it encourages more of the same, if not a green light to the offending party to escalate the violence because YOU have just proven yourself to be the easy mark.
Now while tragic and unavoidable, I can see no fault in our agent engaging a threat. That invisible border is no different than the threshhold of your house or your yard. You have a right to defend it, and you have a right to defend yourself. And you are correct that the incident would not have happened if that individual was not running drugs. Those facts do not justify making being a drug mule a capital offense. Nicodemus, I hear you and agree with you 100%! I too live on the Arizona/Mexico border. Approximately 6 blocks from the border fence in fact. Based on where you say your ranch is, I reckon I live about 45 minutes to an 1 hour west of you. Heck, you probably shop at the local WalMart here. I have illegals running the alleys behind my house almost every night. My alarm system consisting of thee large dogs lets me know when they are at my gate. People that are not from the area we are from think that we are exaggerating the problems and the dangers of living on the border. I have been the victim of a home invasion by armed illegals while I was home. It was not a nice experience and afterward, I armed my self with a rifle and a pistol. My wife had never allowed a firearm in the house until then.
The illegals and the drug mules control our Southern borders. Janet "do nothing" Napolitano has unmitigated gall to pull her head out the sand and make the statement a while back that "Our borders are now safer than they have ever been." I live at ground zero and I sure do not feel safe! I do not blame the Border Patrol. They are doing the best job they can under the restrictive rules of engagement that Napolitano and Holder have imposed. Most of the time the agents are fighting with one hand tied behind their backs. I believe we should militarize our borders by amending the Posse Comitus Act. The Coronado National Forest straddling Arizona and New Mexico is owned by thee illegals and the drug cartels. There is a sign at one entrance to the national forest at Rucker Canyon telling people to "Enter at own risk. Area not patrolled." The Forest Service folks don't want to deal with the drug runners and I don't blame them. Last I knew the standard sidearm of the Forest Rangers was a .38 Special or a 9mm pistol. I think elements of say, the 10th Light Mountain Division be brought in to patrol the mountain areas with open rules of engagement as these units would be much more heavily armed. We also need increased border surveillance from more predator drones and satellites with real time imaging and the drones armed to the teeth to find these scum as they bring their poison across the border into the U.S. Give them one chance to surrender. If they choose not to, let loose with everything we've got and leave nothing standing or running. Send a clear message to the cartels and smugglers that we will hit them at the border and in their pocketbooks! The current administration refuses to even consider getting tough and hopes the problem will just go away. More voter base if we leave them alone and give amnesty. The real victims are those of us that live on the border and have to deal with the results of Holder and Napolitanos's neglect and incompetence on a daily basis. Mexican National shot 10 times in the back while standing on Mexican soil. I read here a lot of whooping, back slapping and high fiving that this is a good thing. There was a time in American when being a Back Shooter was considered dishonorable. I guess for some here, that is an outdated morality. I think I will stick with the old American Values of trying to own the moral high ground, and not endorse shooting people in the back, even if they are rock throwing drug smugglers.

If you read the article, you would have noticed that agent in question discharged his firearm once. ONCE! Not the 25 times a Mexican doctor allegedly stated. The amount of rounds in the average 9mm pistol CBP agents carry is about 9 rounds. That is even assuming he was an expert shot and hit center mass with every round in a crisis situation. Think about it. I'm sure you would stand there and not defend yourself if someone was throwing fist size rocks at your head from the length of a school bus away? How do you know the man was not bending down to pick up another rock from behind him? Get real. This is not about the morals and American values you are trying to throw in. It is about survival! here is the deal. the BP agents observe these guys dropping their load of drugs in America the BP goes after them and they take off at 900 miles an hour KNOWING they are in trouble and then stop at a certain point inside mexico and hurl rocks at the BP agents.......since they acted out in aggression ( fired across the boarder from mexico first) then the sovereignty line don't mean crap at that point , the BP had every right to fire back and defend themselves. BP agents are injured all the time by sh@theads throwing rocks over the boarder at them . they throw rocks on a DAILY basis. maybe all of you peace love and bobby sherman people should take a ride with the boarder patrol and see what it is really like and then you would not be so sympathetic to these (poor) mexicans. they know what they are doing. hollywood movies are not a good source of information . more so when it says ( based on a true story) ha! it is so bad you just have to be there to truly understand the situation.

I was deployed once to Panama for the Cuban Refugee Crisis. I patrolled Camp 5. And when those "refugees" started thier riot, they used rocks and tent poles and anything else they could use as makeshift weapons. I saw what kind of damage a rock can do to the human face, and I have seen what an open skull fracture looks like. And certainly anyone hurling even a pebble my way isn't going to be shown hugs and kisses or a little swat on the hiney. The Current Administration has already done that on OUR side of the border with his signs telling US CITIZENS not to walk on land belonging to this country for thier own safety.

#2. I certainly agree the borders need to be secured. The issue is politicians are too damned worried about pissing off the "legal" hyphanated Americans who shelter, encourage, and AID the illegals coming acrossed the border, OR the special interest groups that pump money into thier campaign coffers, OR the libtard factions like the ACLU that seem to think the rights of the violators are more important than the offenses they committ, OR the sympathsizer, bleeding heart types that are willing and all too eager to embrace the offense as justification to just erase the concept of a border in the first place.
#3. I wholeheartedly agree there needs to be open and frank discussion, putting aside whatever party faithful notion and the too worried about stepping on stubbed toes to address it. But it does leave on to truly question the motives of those in charge, and why with the promises of transparent government do we see things like Fast and Furious, the suing of states that desire to aid and assist the federal government in THIER inability or unwillingness to enforce THIER own laws, mandated by the very constitution they seem to think applies to everyone else more than the citizens it was written, fought, and sacrificed for.

riverboy21 energy is not really an issue with electric fences. i have one around a section of my yard for my dogs. they like to tunnel under or jump over. to solve that i put an electric wire on the top and bottom. i use a solar charger to keep it electrified. no energy problems there.

In case all of you aren't aware, a young individual was killed. He may not have been Mother Theresa, but I think celebrating his death is a little much. Maybe one of the Cartels took a family member and was forcing him to be a mule? Cases of that are extremely common and well documented. I hear what you are saying here and I agree. To take a life when it is necessary and the right thing to do is one thing. But to celebrate it and be joyous when it happens is another. To do so makes you no better than the person(s) who needed to be put down. I think that whoever is thrilled and celebratory when someone is put down is in every way as unstable as the monster that was killed. This applies in every case whether it is this one or in the cases of murderers, rapists, child abusers, and child molesters. There is no argument from me that these abominations need to be put away, not because I hate them, but because it is the only sure way to guarantee that they never hurt another person again. Furthermore, I think that wishing any kind of torture or visitation upon themselves of the same deeds that they have brought onto others is wrong as well. Just kill them quick and be done with it. I agree that it is necessary to end them, I just don't think that we need to drop ourselves down to the levels of those who have committed these heinous acts.
We are seeing too many illegals entering this country and the 'President' is coddling them! I live in Maryland near the PA border, and you'd be susprised at how many Mexican people that are construction workers, farm workers, landscapers. Some come into where I work, and can't speak a lick of english. I'm not being racist or saying that they are all illegal, but probably a few may be. In a time where jobs are hard for the American people to get, the illegals sneak across the boarders, get jobs & get paid under the table, and send the money back across the border..

If people were not hiring them or checking their legal status before hiring them then we might have a better argument. People will do what is in their best interest and if a crew of illegals are willing to do the construction cheaper than the legals, guess who gets hired? People need to realize that in order to solve the problem, EVERYONE needs to take responsibility. Sure there are laws in place to keep illegals from being hired but there are also laws that state all businesses have to pay taxes and not all do. Capitalism is to blame, everyone does what is in their own best interest, legal or illegal be damned.

point in case my cousin owns a land scapping business. lately she has been dealing with these land scapping corporations that higher illegals then ship them up to new england to work. they have been undercutting her due to the cheap labor ( they can charge it by not having to pay any of the taxes and only paying their workers 3 dollars an hour). since this has happened she has had to lay off 10 of her workers. she pays a good wage as well over 15 dollars an hour for her employees. so tell me how is this helping our economy.
