Hearings for accused Sept. 11 terror planners haggle over rights, secrecy

The military tribunal of 9/11 terrorism suspect Khalid Sheikh Mohammed and four co-conspirators resumed in Guantanamo Bay, Cuba on Tuesday, plunged into arguments over one of the thorniest subjects that the court must iron out before the trial — whether the suspects can talk about their detention and harsh interrogation in secret CIA prisons prior to their transfer to Guantanamo Bay in 2006.

The men are accused of planning and providing logistical support for the Sept. 11, 2001 attacks by hijackers who crashed planes into the World Trade Center, the Pentagon and a field in Pennsylvania, killing nearly 3,000 people.

Mohammed and the other four who are portrayed as his underlings face charges that include terrorism and murder, and they could be sentenced to death if convicted.

This week’s proceedings hear arguments on 25 pretrial motions dealing mainly with privacy issues and the detainees' rights, and set the ground rules for the trial which is likely at least a year away.


Prosecutors have asked the judge to approve what is known as a protective order intended to prevent the release of classified information during trial.

The gag order prohibits mention of what the defendants experienced or learned during their interrogation because the tactics used on them were classified.

The defense argued that the government gave up the right to keep interrogation tactics classified when they exposed the defendants to the process.

They mainly object to one portion of the order, which says that, "Any statements made by the accused are presumptively Classified Information." The defense teams believe that that is too broad a statement, and that there is no such thing as "presumptive classification" — that information is classified or not.

The judge, Army Col. James Pohl, pushed back on their argument, saying that both sides agree with the definition of what is classified and what is not, and that the attorneys are required not to disclose new information they deem could be classified.

"We're not talking about what you had for lunch today," Pohl said.

But an attorney for Ramzi Binalshibh argued that issues just that mundane do become a hindrance, citing an example from defending another detainee.

After several hours of arguments against the protective order, the judge did not rule on the motion to strike the gag order Tuesday.

First Amendment appeal
Instead, Pohl moved on to hear arguments from First Amendment attorney David Schulz, on behalf of 14 U.S. news organizations seeking to report on legal proceedings at Guantanamo — classified information or not. 

Schulz argued that the gag order should be lifted because the information about what happened to the defendants during their interrogations has been widely reported in the media.

"The New York Times is not a classification authority," Pohl shot back, saying that just because something is reported in the news or widely known doesn't mean it's now unclassified.

Schulz argued that the use of the 40-second delay switch also violates the First Amendment, but Pohl dismissed that, as well, saying that the switch can prevent the release of classified information that is inadvertently disclosed.

ACLU attorney Hina Shamsi was next to argue for more open proceedings, saying that when issues such as rendition and torture are under discussion, the public has a right to know about it.

Shamsi added that the public should be able to determine for themselves whether punishment is justified, the decide on the lawfulness of government actions with the defendants, and the overall fairness and legitimacy of these proceedings.

The judge stopped her there, saying the court would recess for the day to respect the defendants right to afternoon prayers.

The court will take up this argument again at 9am Wednesday, when the ACLU attorney will continue her arguments.

Last minute boycott
All five of the men were at Monday’s hearings, but on Tuesday, Mohammed, Saudi defendant Mustafa Ahmad al-Hawsawi and Pakistani national Ali Abd al-Aziz Ali all bowed out. Walid Bin Attash and Ramzi Binalshibh, both from Yemen, did attend.

Mohammed, who has previously claimed he was the mastermind of the terrorist attacks, was taken from his cell at the U.S. base in Cuba to a holding cell outside the courtroom, then chose to boycott at the last minute, said a Navy officer whose name was not released by the court for security reasons.

He did not give a reason for sitting out the Tuesday hearing, but on Monday he dismissed the military tribunal with scorn, saying "I don't think there is any justice in this court."

Pohlruled Monday that the defendants have the right to be absent from this week's pretrial hearings, but said they would have to attend the trial.

The chief prosecutor, Army Brig. Gen. Mark Martins, had argued that the rules for the special war-time tribunals known as military commissions required the defendants to attend all sessions of the court.

But lawyers for the men disagreed, arguing that the threat of being forcibly removed from their cells would be psychologically damaging for men who had been brutalized while held during their captivity by the CIA.

The U.S. government has acknowledged that the defendants were subjected to "enhanced interrogation techniques" which in some cases included the simulated drowning method known as waterboarding.

"Our clients may believe that ... 'I don't want to be subjected to this procedure that transports me here, brings up memories, brings up emotions of things that happened to me,'" said Jim Harrington, who represents Binalshibh.

Harrington's statement elicited groans from a small group of family members of Sept. 11 victims who were chosen by lottery to view the proceedings at Guantanamo.  A few other families watched the proceedings on closed-circuit TV from U.S. military bases in New York, New Jersey, Massachusetts and Maryland.

Also on Tuesday, the court dealt with what the detainees are allowed to wear in court.

The attorney for Mohammed, U.S. Army Capt. Jason Wright, explained that his client wants to wear a military-style camouflage vest over his traditional attire. He argued that Mohammad wore military-style clothing when fighting against the Soviets for the U.S. government in Afghanistan, so he has a right to do so in this courtroom, as well. Not allowing him to wear it undermines his presumption of innocence, the attorney argued.

Pohl said that the defendants would not be permitted to come into court in a complete U.S. Army uniform, but, he would not forbid all camouflage.

The five men were arraigned in May, and subsequent hearings were pushed back for various reasons.

A hearing in July was postponed to allow the defendants to observe the holy month of Ramadan. Hearings in August were delayed when an Internet outage left the lawyers unable to access their electronic legal documents. That hearing was later canceled altogether as Tropical Storm Isaac approached.

A hearing scheduled for late September was also delayed because the work space for the defense lawyers was shut down due to a rat infestation and mold, which lawyers claimed were making them sick, Reuters reported.

Pohl ruled on Oct. 5 there would be no further postponements to the hearings.

An earlier attempt to try the five men at Guantanamo ended when the Obama administration tried to move the trials to New York City, where two of the hijacked planes slammed into the World Trade Center.

That was abandoned under pressure from Congress and from New Yorkers, and the charges were re-filed in Guantanamo.

The two people who should stand trial for 9/11 are Bush and Cheney, well and luck Larry Silverman, the owner of the buildings. But of course that will never happen, they found their scapegoats, the propaganda machine had everyone begging for revenge and freedom fries instead of facts, so the real criminals will not only get away with it, they got a big fat paycheck from the American tax payers.

Only a fool would believe or follow such a shallow doctrine as your own. You have no proof of anything you say, except the fact that you perhaps have forgotten your medications, I'd suggest reading the 109 verses in the Quran the preach violence against any non- muslim, that includes buddhist, catholics, jews, ... the thought you wouldn't have the oppurtunity to speak your mind in such a country as Iran unless fully supporitng their government like a puppet, you'll forever be the sheep of society.

The Freedom Fries had absolutely nothing to do with these prisoners nor with the Iraq war. Freedom Fries came when americans decided France was being treasonous because they did not believe the Bush Administrations claim of Iraq having Nuclear weapons and nuclear plants in construction which later turned into WMDs or chemical weapons. It turned out that France was right. The Bush called every nation that did not agree with him at the United Nations cowards with yellow streaks running up their spines and made the claim that any nation that was not with us supported terrorism. France declined and was not intimidated thus the claim that they were treasonous and to the point they wanted to rename french fries, Freedom fries in retaliation.

This claim was proven to be true when after Operation Desert Shield/Operation Desert Storm, came to an end. The very incubators the Kuwaitiis claimed the Iraq military stole after tossing the babies to the floors and walls, were found hidden in the very hospitals that the claims stemmed from. Nor were innocent people lined up at trenches and murdered as claimed but the Kuwaitiis themselves emptied their own jail cells and lined up the prisoners and executed them and used those murders as proof of Iraqi atrocites.

Actually the claim was proven to be false when it was found that the woman who made that claim was not who she claimed to be either. Boy the wingnuts just don't know when to give up on an already exposed lie.

Caleb Hesse, 52, is a well known anti-gay activist and former elementary school teacher. He has been charged with four lewd acts on a child. The investigation is in its early stages and incidents of abuse going back to 1987 have been reported, but that is by no means a cut off point for Hesse's abusive history and authorities are encouraging anyone with knowledge of past abuses to please contact them. Some of Hesse's victims may now be 40+ years old.

The former youth group volunteer confessed to police that he had "inappropriate" contact with children over the last three decades, with the most recent sexual abuse happening in the last week. Many of the abuses took place at summer camps hosted by the Evangelical Free Church of Yucca Valley where Hesse was an active participant and supervisor since the early 1980s.

I feel some replies to you have been 'overly stated', yet i understand the emotions behind their statements. I do agree you have not offered any proof of your opinions, but neither have the other respondents. The Bay Of Pigs is a historical fact, The Gulf of Tonkin misinformation of the N. Viet attack on a US Ship which initiated the US entrance in to the Vietnam Conflict is now historical fact....yet you yourself did not provide any facts that support your supposition that the US Gov. was behind the 9/11 horrors. These former US war instigations have no direct tie to 9/11. I have seen 'movies' suggesting that the 9/11 attacks were US Gov initiated but the 'historical fact' certainty is not yet a certainty. We all will have to wait, as we did with the 'Kennedy Assassination' . Until then may I humbly suggest you clearly state your assertions as your personal 'opinions' rather than using previous historical incidents to validate a yet unproven one.

why did WTC building 7 fall? fire? only two other structures of that magnitude have ever fallen cause of fire, they both happened the same day as WTC 7.

why was no fuel found where flight 93 crashed? better yet, why weren't any bodies or plane parts recovered from that site? the whole thing was obliterated and yet they try to tell us that a handkerchief and id's, two very weak items in comparison to jet engines, were not only the only things found but were perfectly intact.

why were supposed parts of 93 found 6 miles away if it crashed and wasn't shot down?

why was explosive residue found in the dust from the twin towers? more importantly why did NIST say there were no explosives when they didn't even test for them and admitted they didn't?

why did we immediately sell off the debris from these sites instead of investigating? they got rid of all the evidence and got paid for it too.

if you're not asking questions you're a sheep. those who don't know their history are doomed to repeat it. lusitania, tonkin, iraq, pearl harbor, i think we've repeated ours enough. it's time to stop it.

as far as proof it's hard to get when there's been no official investigation worth a damn. there are a hell of alot of things that don't make sense though, too many for what they are telling us to be factual.

HATR - those all all good questions, and I would like to know the answers as well, but to blindly say that not having an answer (one way OR the other) = inside job is a bit short-sighted. Rain used to be attributed to the Rain Gods, because the real answer was unknown. . At the time. And then there's the crop circles....

I agree these questions should be looked into. By independent researchers. And when enough reach the same conclusion, we may know. But not knowing does not equal conspiracy.

    how about this fact

    the buildings that fell all fell in free fall for at least a short period. the towers did so even below where the planes hit. a building can't fall in free fall unless part of it below the top has been removed or destroyed because it would hit the rest of the structure. WTC 7 fell in free fall for over 100 feet or 8 floors. the only way that happens is if the reports of explosions inside the buildings, including the one that wasn't hit by a plane, were true. also, buildings collapse towards the side of the damage yet all the buildings fell straight down, not to any side angle, which only happens in a controlled demolition. there are just too many discrepancies between what they say and what is already known to be possible.

        Astonding - to "Hang them for being who they are anyway..." is the mentality we strive to be above. Any less and you become the people you preach to hate

        Deprog - I agree "the propaganda machine had everyone begging for revenge and freedom fries instead of facts..." but that is a natural kneejerk reaction. The conspiricy is a pretty big pill to swallow without hard cold facts.

        And to everyone else, TRY not to let your personal politics get in the way of facts. The "Us vs. Them" we have become is both embarrassing and weakening us as a nation, so if we keep it up, none of this will matter soon.

        One thing at a time. First, guilty or not guilty of terrorism and murder. Then address the treatment during detention. If crimes were committed, the charges should be answered to, no matter who committed the crimes. Treatment in detention has no bearing on whether they committed the crimes or not prior to being captured or arrested.

          If any good is to come from the trial and conviction of an Islamic terrorist, the execution will need to be performed Black Jack Pershiing style. Tie them to a stake next to a big hole. Have the firing squad dip their bullets in freshly slaughtered pigs blood. Then throw their dead worthless carcasses in the hole along with those freshly slaughtered swine and covered over to be forgotten. Film every second of it and send the film to Al Jazeera for broadcast along with the warning to these animals of the same fate awaiting them if they don't chill out.

          When Pershing commanded US forces in the Phllipines, he did exactly that when the Moros were causing problems. Differing only in the method of sending the message. He kept one of them alive to deliver the message to his brethren. It solved the problem.

Most important is the Immigration Laws, and the granting amnisty to 850,000 more Idiot's that can not figure out how to tie their shoes in the morning, let alone how to take care of the 15 to 20 kid's they have just through at America, and wanting our jobs, even though they don't know how to tie their own shoes.                   Mohammed, who has previously claimed he was the mastermind of the terror attacks, did not give a reason for sitting out the Tuesday hearing, but on Monday he dismissed the military tribunal with scorn, saying "I don't think there is any justice in this court."

                  I am so glad to see our due process in action, giving these terrorists the opportunity for justice and how the self-proclaimed mastermind of the attacks is still walking on this earth(extreme sarc.)

                  But lawyers for the men disagreed, arguing that the threat of being forcibly removed from their cells would be psychologically damaging for men who had been brutalized while held during their captivity by the CIA.

                  oh and going to work and having a plane flown into your office and collapsing the twin towers isn't psychologically damaging to this entire country...America gets what it deserves for giving this trash a place in court. and no, i don't feel better then they are. if the proclaim responsibility for the attacks than they all deserve to die. terrorists around the world are laughing at us.

                          The
                          F.A.A. - Federal Aviation Administration is supposed to contact N.O.R.A.D.
                          immediately about all off course jets. This did not happen.

                          On 9
                          -11 Cheney had N.O.R.A.D. on practice maneuvers in three locations one being in
                          Alaska. Learning this, I understand why N.O.R.A.D. was not given the 'shoot
                          down order' for the off course jets of 9-11.
                          It's all very, suspicious. Looks like 9-11 was an inside job, it was too
                          clean

                          Later
                          on 9/11 there’s a passenger jet that flew into one of the towers while there is
                          another jet flying to the west coast turns around in the state of Ohio heading
                          east. This jet was off course 15 - 30 minutes. Common sense tells anyone there
                          is a jet in a Twin Tower shoot this other one down. This was the other jet that
                          flew into the other Twin Tower.

                          They
                          cleaned up the Twin Tower debris fast. It seemed they didn't investigate any
                          items or of possible evidence of an explosive material. Did nothing. Swept it
                          all up real quick. In comparison to one jet crash it takes weeks to investigate
                          and gather evidence. Also to identify bodies, who is who? They swept all body
                          parts up too?

                          Five
                          weeks after 9-11, the Patriot ACT was a proposed bill and signed into law this
                          same week. Bill number, HR 316RDS. 342 pages of legal words, (not everyday
                          words). Laws have codes, which are related to another law with codes. When a
                          law consists of a code / statute you look up that code and coincide it with the
                          other. It takes much research to find the whole meaning of one law. You may
                          need three or four different volumes of law statute books to find the meaning
                          of one law. The Patriot Act was passed by Congress as a response to the [so
                          called] terrorist attack of 9-11.

                          I saw the Patriot Act 342
                          pages. I am disgusted the government to think I could be ignorant enough to
                          believe all this was written in five weeks time.

                          Common
                          sense will make any human realize the Patriot Act could not have been written/
                          invented in such a short period of time. With all the research needed to
                          complete the Patriot Act. To me it would seem it would take one hundred
                          attorneys at least one year to conduce all this information within the Patriot
                          Act.

                          Five weeks? Are we the people that naive? Obviously most of
                          us are. A huge percentage of this act is against our U.S. citizens Civil
                          Rights. There really isn't much about foreign terror.

                          On 12-11-07 I had met a man that was in the Navy. 1994 just
                          when he was about to leave boot camp an officer stopped him. Handed him a 75
                          page document titled Patriot Act if he did not sign it he would be unable to
                          continue with a Navy career. Proof the Patriot Act was not made because of 9-11
                          as Bush said many times. Proof of another lie from Bush.

                          John
                          Conyers Jr. a Congressman, Democrat for Michigan. He was asked how congress
                          could have passed the Patriot Act without reading it? Conyers response
                          ,"we hardly read any of the bills given to us."

                          Early
                          in 2006 on the History channel, it covered the White House knew about the
                          Japanese flying towards Pearl Harbor. Not warning anyone of this, because the
                          U.S. government in reality wanted to go to war in Germany. After Pearl Harbor
                          we were in world war 2. All
                          the information I gathered, it seems Bush, Cheney, etc. orchestrated 9-11 with
                          the same tactic as in Pearl Harbor, Twin Towers. Sacrificing lives at Pearl
                          Harbor as at the Twin Towers. No difference, same motive.

                          The motive to have an absolute excuse/action , was[the TWIN
                          TOWERS]. Therefore making most everyone believe to go to war. Even though it
                          was a U.S. plan as I think just as many others do. It was plan. The real
                          terrorists and architects for 9-11-01, points directly to the U.S.A.'s
                          Executive Branch. The Twin Towers was a mask for Bush to use Signing
                          Statements, promote the Patriot Act and go to war.

                          Cheney
                          is profiting from the war through the company Haliburton. Which is called 'War
                          Profiteering." This is against the law and inhumane too.

                          Bush kept putting fear and hate in everyone’s head and heart.

                          It's hard to think our government would do
                          these criminal acts. Most of the U.S.
                          people think our government would never do such a thing. Which is the main
