Islamist leader jailed for inciting deadly attack on US Embassy in Tunisia

Updated at 8:19 a.m. ET: TUNIS, Tunisia - A leader of radical Islamist group Ansar al-Sharia was sentenced to one year in prison on Wednesday for inciting an attack on the U.S. Embassy in Tunis last month in which four people were killed.

The conviction of Abu Ayub was the first in connection with the attack - launched to protest against an anti-Islamic film made in California. The United States has been urging authorities to jail those responsible.


"The judge decided to jail him on charges of inciting violence ... This decision is unfair ... we will go to appeal," said Rafik Ghak, a lawyer for Abu Ayub.

The authorities arrested 144 people, including two prominent leaders of Ansar al-Sharia after the embassy attack. Saif-Allah Benahssine, the leader of the group, has urged the government to release them.

Benahssine on Tuesday accused the country's government of being a puppet of the United States and un-Islamic.

Protests ignited by a controversial film that ridicules Islam's Prophet Muhammad spread throughout Muslim world.

The United States this month requested Tunisia bring the embassy attackers to trial, pledging to continue its support for the democratic transition in Tunisia.

Tunisia expects Washington to guarantee around a fifth of its $2.2-2.5 billion borrowing needs next year to help its economy recover from last year's revolution, the country's minister of international cooperation, Riadh Betaib, told Reuters last month.

Meanwhile, the Tunisian government confirmed Wednesday that it has arrested a 28-year-old Tunisian reportedly linked to the U.S. Consulate attack in Libya.

A man is being held by Tunisian authorities as a "person of interest" in the deadly attack on the US consulate in Benghazi, Libya, that killed US Ambassador Chris Stevens and three other Americans. TODAY's Natalie Morales reports.

Tunisian Interior Ministry spokesman Tarrouch Khaled said that Ali Harzi was in custody in Tunis. Khaled told the The Associated Press "his case is in the hands of justice." He did not elaborate.

However, Harzi's lawyer told NBC News that his client was innocent. Oulad Ali Anwar said Harzi was working in Benghazi as a house painter at the time of the attack and said he denied both attending the demonstration at the U.S. Consulate and belonging to any extremist group.

Rights group blasts 'repressive' crackdown in Tunisia, birthplace of the Arab Spring

In Washington, the State Department had no comment. Earlier this month, Defense Secretary Leon Panetta said the U.S. has been looking into the arrests of two Tunisian men being detained in Turkey reportedly in connection with attacks on a consulate in Libya last month.

Ambassador J. Christopher Stevens and three other Americans died in the attack on the U.S. diplomatic post in the Libyan city of Benghazi on Sept. 11.

State Department emails obtained by NBC News raise more questions about what was known by the White House regarding the Benghazi attack. NBC's Andrea Mitchell reports.

Yes there was. What most need to realize is that this is just the beginning of prosecution, and be happy there was a prosecution at all. This is a step in the right direction for the ME. Holding the agitators just as responsible as the actual players,when death is a result of their words. The sentence was surley too light. We will push for harsher consequences in the future. Not too long ago the government would have turned a blind eye and let these guys out of town, this time the people found them and extracated them from their head quarters, very good sign,but hey use this as your opportunuty to try to advance your political position as Romney did very shameful using others tragedy in this vane.

Coral, sorry for any misunderstanding but my sarcasm key is not working.

I saw the photos of the Ambassador's dead body as he was being dragged through the streets. Did you??? It will be a long time before those images will be forgotten. The throng of monsters - and yes they are monsters - was so thick, you couldn't see the road. The stomach area of the Ambassador's body was a mass of colors from bruising. The horrible lump on his forehead was huge. Can you imagine the beating that man took??? I can only hope that he died quickly.

Thank you but I'm well aware that there was more than just one monster involved in these murders.

As far as the beginning of a prosecution, I'll have to see a whole lot more than just one little sacrificial lamb so that they can get their borrowed $$$ to pay for their little revolution.

It's true, the Imams and Clerics rant and rave about the "corruption" in the west because they have nothing to contribute to making lives better for their own people. This is not new. The Islamic world has been condemning other cultures for centuries as 'idolatrous", then attacking at the smallest provocation. When they are too weak to attack they turn on themselves attacking sects perceived as "unIslamic", or they attack diplomatic missions of stronger countries. In cultures where Islam has wiped out all other cultures, they outlaw the joys of life as being "unislamic" such as dance, music, real education and the arts. Criticism of their behavior or religion is perceved as an act of war. They follow the example of the "Prophet" whose followers would dispatch his critics, (male and female, young and old) as recorded in the hadith.

The highest form of contempt is to outlaw the religion of others, which is what they do in the heart of heart of Islam.

One only needs to read the diatribes of Sayyid Qutb in his polemic "Milestones" to understand the contempt that the Muslim Brotherhood has for the west. Muhammad Atta was a card carrying member, so was Bin Laden so was Al Zawahiri etc...

Any culture where the base of power is through contempt of others will fall into war. If the war is not external, it becomes internal, as it has in Syria and Pakistan.

Perhaps a little introspection and objective deconstruction might help the Islamic world. But, then again, self criticism or honest examination might be perceived as apostasy.

My appologies if I offend any Muslims for being so critical.

First off the White House does not form my opinion. Now one more time. The film is not what caused the attack, the people were fired up by Imams and Islamist to riot, the Islamist used this as their opportunity to attack. Why is this so hard to understand, because you want to prove Obama was wrong about it,you cant even do that, even if he was wrong, I would call it a misinterpratation more than a lie.

Coral - The point here is that the white house claimed it was not a terroristic attack until 13 days later....yesterday MSNBC from Reuters had a story that the white house knew it was a terroristic attack two hours after it happened...Reuters has the emails...therefore, obama lied to the American people about the cause of the attack and should be held accountable....also, the embassy had begged for more security and it was denied...hillary is calling for more time for the investigation....probably so they can create evidence that matches their story....

This attack is exactly what the religious right in America is involved in.. Lobbying to create problems for normal everyday citizens that think nothing of religion and only revolve around social responsibility.

Ambassador Stevens did not die in the consulate and was 'dragged through the streets'. People found him semiconscious and rushed him through the streets to get him to the hospital--he was still alive when he reached the hospital. He died of smoke inhalation. The majority of the people in Benghazi liked him and wanted the peace he was advocating for, and when he died, about a week later the people rose up and stormed the compound in which the militants were hiding and drove them out of the city.

It is true that Obama mention the word terrorist, however if you read the transcript of his speech, he mention terrorist in a context of the memorial of 9/11 2001 , he never made an actual statement calling to the incident in Benghazi a terrorist attack, not at that time because it was "under investigation" not after when the White House sent Ambassador Rice to all Sundays Shows to tell to the American Public , that the attack was an spontaneous response to the Mohammad film, Obama continue denying the terrorist word to the attack in Benghazi in his speech at the UN. In order to make your statement true , Obama never should call spontaneous to something in fact was not, and flame tha film the was not also the cause of the attack. Obama intentionally lie mislead for political reasons.

There was a protest against the anti--Islam film in Tunisia incited by Saif Benahssine that resulted in four people dead. This is completely separate from the attacks in Libya, and the four who died were Tunisian citizens/protestors. See below:

Violent clashes broke out on Friday between security forces and protesters, who were protesting over the anti-Islam film produced in the United States.

No. Let's not, because he wasn't jailed for the film, he was jailed because violated the terms of his parole!

He was previously convicted of, and served jail time for, stealing people's social security numbers, setting up fraudulent checking accounts with those stolen numbers, then writing checks that transferred money from the SS number holder's bank account to his fraudulent account, then withdrawing it, thereby stealing the legal SS number holders' money. Since this was all accomplished via online banking, the terms of his early parole were that he not engage in fraud, not misrepresent himself by using pseudonyms, and to have no access to the internet while unsupervised until his parole period was over. He violated all of those terms and he belongs in jail to serve the rest of his sentence.

If this was your social security number he used, and you knew he was convicted, served jail time, then you found out he'd violated the terms of his parole, would you want to see him out of jail again? People complain about illegals stealing social security numbers, why should a citizen who did the same thing get a free pass?

If this guy is let out of jail, it's very likely he'll steal more social security numbers, set up more fraudulent accounts, steal more money and use it to flee the country. One of those numbers might be yours. Would you 'donate' money to him to help him flee the country?

The four deaths in Tunisia WERE as a result of people protesting over the film:

The protestors were all Tunisian citizens who were rioting in the street because Saif Benahssine got them riled up. None of the dead were US citizens. This is for all intents and purposes, an internal affair for Tunisia and we should not get involved--they have sovereignty over their citizens.

Blessed Goddess, there are a LOT of confused people posting here today!!!I am absolutely POSITIVE (after going through the four pages of comments so far on this article) that MANY people have Libya and Tunisia mixed up.

Again: The video was not the reason for the Benghazi attack but it WAS the reason for the Tunisia incident.

Saif Benahssine didn't kill four people. He, apparently, was one of the religious leaders who saw the anti-Islam film, either showed it/spoke of it to a large number of his followers in the al-Fatah mosque (thanks for the correction in post 4.4, liarsinpolitics) and told them to go out and protest. When his followers stormed out of the mosque and protested in front of the Tunisian embassy, he sneaked away and ran and hid. A cowardly act from a coward.

It would be somewhat equivalent to a leader of a religious sect who doesn't like gays telling his people to go out to protest at (for example) a gay pride parade, but didn't go himself, and someone got killed. The leader himself is not responsible for the killing but is guilty of incitement.

So Benahssine was charged with incitement, but as he did sneak away and was not present at the embassy protest, they can't get him on murder. Three of the protestors were shot by Tunisian authorities guarding our embassy, and one got run over by a passing car. Sorry, I don't have a whole lot of sympathy for them--they should have had more sense than to follow the orders of a misguided religious leader who didn't even have the cojones to LEAD this protest himself. my kids have more sense than to listen to someone who says 'do as I say, not as i do'. And sorry, no sympathy for the protestor who got run over by a car--could you NOT have gotten out of the freakin' ROAD?

The United States condemns in the strongest terms this outrageous and shocking attack. We're working with the government of Libya to secure our diplomats. I've also directed my administration to increase our security at diplomatic posts around the world. And make no mistake, we will work with the Libyan government to bring to justice the killers who attacked our people.

Of course, yesterday was already a painful day for our nation as we marked the solemn memory of the 9/11 attacks. We mourned with the families who were lost on that day. I visited the graves of troops who made the ultimate sacrifice in Iraq and Afghanistan at the hallowed grounds of Arlington Cemetery, and had the opportunity to say thank you and visit some of our wounded warriors at Walter Reed. And then last night, we learned the news of this attack in Benghazi.

As Americans, let us never, ever forget that our freedom is only sustained because there are people who are willing to fight for it, to stand up for it, and in some cases, lay down their lives for it. Our country is only as strong as the character of our people and the service of those both civilian and military who represent us around the globe.

No acts of terror will ever shake the resolve of this great nation, alter that character, or eclipse the light of the values that we stand for. Today we mourn four more Americans who represent the very best of the United States of America. We will not waver in our commitment to see that justice is done for this terrible act. And make no mistake, justice will be done.

But we also know that the lives these Americans led stand in stark contrast to those of their attackers. These four Americans stood up for freedom and human dignity. They should give every American great pride in the country that they served, and the hope that our flag represents to people around the globe who also yearn to live in freedom and with dignity.

We grieve with their families, but let us carry on their memory, and let us continue their work of seeking a stronger America and a better world for all of our children.

Obama was talking about act. of terror , and the word terror is synonymous of fear, horror, dread, fright, alarm, trepidation, shock, panic. It does mean that an act of terror is is not necessary caused by a terrorist , it coul be cause by a infuriated mob , like the protesters for the Mohamad film that Obama mention for more than a week.
In fact Obama define the act but not the actors in his speech, which is totally different semantic.

Obama needed a scapegoat to sheild his leagacy from presiding over a terrorist attack and in finding one he handed the Muslim world a reason for further violence/vandalism.

The four deaths in Tunisia were as a result of people protesting over the film; no Americans were hurt; three of the people who died were shot by the Tunisian authorities for trying to break into the embassy and one poor idiot got run over by a freakin' car:

You would think that people would like to gather views and form an opinion but they watch inflammatory statements on Fox and then deny that it could have been any other way. Sean Hannity last night was totally fixated on Benghazi with a supporting cast of sycophants including Liz Cheney.

I was sent the video purporting to be Lybian thugs dragging the Ambassador through the streets. Sodomy of his corpse was mentioned as well. It turned out, as you say, to be an inflammatory interpretation. The crown rescued him from the burning building and rushed him to the nearest emergency room. The Doctor was interviewed on CNN and said he tried everything to save him but Ambassador Stevens died of smoke inhalation and asphyxia. By the way Fox Fans, he had no other injuries to his body.

In a similar vein, I read the report by the Chairman of the 911 Commission. For the longest time, Cheney's Dad and the rest of the Situation Room received conflicting intelligence about the planes - and guess what - they understandably got a lot of facts wrong. This includes the number of planes involved and which plane hit what. The Monday morning quarterbacks are always right but I have the utmost sympathy with the GWB gang for having to interpret on the fly. Obama tried to be real time transparent on this and the Right is trying to score points. Having a thorough investigation of all the intelligence is the only way to go on this. Well done Mr. President.

It's obvious that many here are confused in a few points:

1- The revolts through the Middle East had started a few hours BEFORE the Benghazi attack (which might have been used by the AlQaida group as a great opportunity for them to carry the 9-11 attack).

2- This article is about Tunisia, and the four killed here were Tunisian attackers, NOT Americans.

3- Attacks on western property at Egypt, Sudan, and many other Muslims countries where going at the same time and based on the film. They had no way to know at first about the attack on Benghazi.

Oh, I forgot to add, I never said Americans were killed and I never thought they were. I am not confusing Libya and Tunisia, or the Benghazi event. The cleric Anwar al-Awlaki didn't kill any Americans either but they assasinated him for inciting violence and agreeing with Al Qaeda's views. To be clear I am not against the assasination, just saying you don't have to kill Americans to get a drone strike and I never once said Abu Ayub did kill Americans.

    Amanda you seem to be the confused one here. I understood exactly what riverboy21 is trying to say and you are making some huge assumptions and putting words in his mouth. Anwar al-Awlaki was an American citizen living in Yemen as a Cleric and spiritual leader. He called for protests, violence, and for the all U.S. diplomats to leave the country of Yemen. He did not plan attacks against Americans but they attempted 3 drone strikes before finally succeeding in killing him. Not sure why you think every single comment here is confusing the Benghazi event when riverboy's had no mention of Americans getting killed, just comparing to an actual similar even that occurred earlier this year.

      Maybe you should look and see what they have done in the past and it might surprise you. There have been a few times that Muslims were killed and no riots or any protests happened. Maybe you should look it up? I remember an incident in Pakistan that I thought might piss off the people, but they barely even cared. Could be something to do with accidents, or any number of things like that person being a martyr and getting a free trip to heaven. For some reason there are no accidents when it comes to Allah, Muhammad, or the Koran however. It is almost exactly like some people are when it comes to Obama... No matter what he does haters are going to hate.

      Peace loving Muslims... What percentage of people took part in the riots or protests? Was it less then 1% of the general population? YES IT WAS. How nice of you to judge an entire religion based on the actions of 1% of that group. Bet we have at least 1% of the Christians that are "bad". Bet we have at least 1% of the Jewish people that are "bad" too. Take any religion, race, or group of humans and I bet $ that at least 1% of them will be "bad". If there are good ones then there has to be bad ones. Simple probability.

      This arrest comes at the tail end of the Tunisian 'Arab Spring' uprising. In Tunisia it has been accomplished relatively peacefully, without the bloodshed that has characterized the governmental change elsewhere in the Middle East. The former government did not try to brutally crack down on the Arab Spring protestors, they held elections last October and chose a new President who is advocating for a change toward a more democratic (i.e. Westernized) government and more freedom and tolerance, and it's just a few people like this hardline radicalist Saif Benahassine who want a return to the old ways. The new democratically-inclined governement will let him have his say, but if he goes over the line and they can find something to charge him with, they will do so. This action is actually a big step forward for Tunisia; no one in the country has ever been arrested and convicted for airing fundamentalist views. By arresting, charging and sentencing through a democratic trial process, they are starting to send a message to the radicalists that their views of hatred are not the views of the people anymore and and it is the will of the people that a democratic government be emplaced.

      Do you not realize that presidents and vps are not security experts. Do you not realize many diplomats reject many protocols of required security in the ME as they are cumbersome.       Easy to answer this question: The President claimed in the second debate that he called this action in Benghazi a terrorist attack, and then for several weeks following he downgraded the attack and blamed it on a protest over a video. Mortat fire takes calibration and planning, this could not have been the result of a protest. There are lies from the White House and the President. There is actually no question, and if you believe otherwise you need serious help

It has become a major story when in real time you have proof that the White House knew in advance of the attacks on Benghazi that Ambassador Stevens was concerned and made it clear they did not have enough security, and the Government forces in Benghazi could not defend the Consulate. It is even mor disturbing that when the e-mails going to the situation room at the White House that stated the Consulate at Benghazi was under attack, nothing was done..... It is known that the President at 5 P.M Eastern Time was in a conference with the VP, and the secretary of defense. It is therefore known that the President and the VP were aware of the issues in Benghazi in real time. This should be so pulicized by the media thatI am in shock that it does not dominate the front page of every news channel. Insulating the White House is no longer an option there will be hearings to determine who is to blame. I believe that the actions here are criminal and it makes sense now that the President wou;d make a statement like the lives of 4 Americans are "Not Optimal". Unbelievable............ This is completely separate from the attacks in Libya, and the four who died were Tunisian citizens/protestors. No Americans died--the Tunisian security forces kept our embassy personnel safe. You know, the scariest thing in the world ins't a shark or being afraid of the dark, it's being proved wrong, and that is what scares some of these people - particularly in a public forum.

                          Here we go again. lets pay someone elses country billions and let us americans starve. Thats real good, they wanted freedom now let them go and get it. The U.S. should not spend that kind of money supporting a country that will kill americans before too long, you watch. We need not support there Goverment in funds when we cant support ourselves.
