India charges six suspects with murder after victim of horrific gang rape dies

A 23-year-old medical student who was raped and attacked on a city bus in New Delhi has died, resulting in charges against six men. Even before she died, her savage attack triggered mass protests about treatment of women. NBC's Duncan Golestani reports.

NEW DELHI -- Six suspects held in connection with the rape of a woman in India have been charged with murder after she died on Saturday of injuries sustained in the attack, police said.

"They have been charged (with murder)," said Rajan Bhagat, a spokesman for New Delhi police.

The woman, who was gang-raped on a New Delhi bus on December 16, died in a hospital in Singapore. The attack has sparked protests and a national debate about violence against women.

The suspects in the rape -- five men aged between 20 and 40, and a juvenile -- were arrested within hours of the attack.

Many Indians have called for the death penalty for those responsible.

Bracing for a new wave of protests, Indian authorities closed 10 metro stations and banned vehicles from some main roads in the heart of New Delhi, where demonstrators have converged since the attack to demand improved women's rights. About 100 people staged a peaceful protest on Saturday morning.


The 23-year-old medical student, severely beaten, raped and thrown out of a moving bus in New Delhi two weeks ago, had been flown to Singapore in a critical condition by the Indian government on Thursday for specialist treatment.

Her body arrived back in India in the early hours of Sunday morning and cremation services almost immediately began, police sources told the Agence France-Presse.

The attack has sparked an intense national debate for the first time about the treatment of women and attitudes toward sex crimes in a country where most rapes go unreported, many offenders go unpunished and the wheels of justice turn slowly, according to social activists.

"We are very sad to report that the patient passed away peacefully at 4:45 a.m. on Dec 29, 2012 (3:45 p.m. ET Friday). Her family and officials from the High Commission (embassy) of India were by her side," Mount Elizabeth Hospital Chief Executive Officer Kelvin Loh said in a statement.

The 23-year-old who was gang-raped in New Delhi and thrown from a bus has died from her injuries in Singapore, where she was being treated. NBC's Natalie Morales reports.

Indian Prime Minister Manmohan Singh said he was deeply saddened by the death and described the emotions associated with her case as "perfectly understandable reactions from a young India and an India that genuinely desires change.

"It would be a true homage to her memory if we are able to channelize these emotions and energies into a constructive course of action," Singh said in a statement.

The woman, who has not been identified, and a male friend were returning home from the cinema by bus on the evening of December 16 when, media reports say, six men on the bus beat them with metal rods and repeatedly raped the woman. The male friend survived the attack.

Body to be returned home
T.C.A. Raghavan, the Indian high commissioner to Singapore, told reporters hours after the woman's death that a chartered aircraft would fly her body back to India on Saturday, along with members of her family. The woman's body had earlier been put into a van at the hospital and driven away.

Indian media had also accused the government of sending her to Singapore to minimize any backlash in the event of her death but Raghavan said it had been a medical decision intended to ensure she got the best treatment.

"She was unconscious throughout," Raghavan said of her time in Singapore. "She died because of the severe nature of the injuries."

Some Indian medical experts had questioned the decision to fly the woman to Singapore, calling it a risky maneuver given the severity of her injuries. They had said she was already receiving the best possible care in India.

On Friday, the Singapore hospital had said the woman's condition had taken a turn for the worse and she had suffered "significant brain injury." She had already undergone three abdominal operations before arriving in Singapore.

Home Minister Sushilkumar Shinde told Times Now television on Saturday the government was committed to ensuring "the severest possible punishment to all the accused at the earliest."

"It will not go in vain. We will give maximum punishment to the culprits. Not only to this, but in future also. This one incident has given a greater lesson," Shinde said.

He said earlier the government was considering the death penalty for rape in very rare cases. Murder carries the death penalty.

You can tell India was a British colony for a long time by all the protest signs in English. Now all we have to do is hope these six guys are really the ones who did the rape. With all the flack the government has been catching from people over this issue, I think they would arrest anyone they can just to show they are doing something about it.

As the attack was on a public bus, I would imagine that there were witnesses on the bus as well as witnesses who saw her being thrown out of it. I don't know if their buses are equipped with cameras and monitoring devices, but it seems reasonable to assume they might have--which would make identification almost a virtual certainty.

My sincerest condolences to the family--and my best and most fervent wishes that this induces a sea change in the way women are viewed there--and not just there, everywhere. In many parts of the world, women are still second-class citizens, at best--and at worst, one step up from livestock, to be bought, sold, bartered and traded by males.

We as a human race cannot hope to advance while we still keep half of our population (the female half) suppressed.

The criminals are in jail, awaiting trial. There will be a trial, with witnesses, and defense lawyers---the whole bit. Indian law is based on English law--there is no difference.

They will probably get the ultimate penalty since the victim died---hanging.

Yes, that's true. I was surprised when watching the PBS News Hour about this last night. They said that when a woman is raped in India, she is seen as having violated the family's honor. In other words, they blame her, and not the rapist. That surprised me because, while I knew that was true of Muslims, I did not know it was true of Hindus as well. I always thought Hindus were more respectful of women. They also said that this sort of gang rape is common all over India. It makes me wonder what is wrong with Indian men.

99.9% of Indians are good, decent folk. In a nation of more than one billion, you are bound to find a handful of criminal types.

It is important to note that: The public masses are supporting the victim and victims' rights.

As far a how girls are treated there: There are equal rights for women. Women have equal rights to employment, education, inheritance, etc. India had a female prime minister for many years. There are female members of Parliment. There are female chief ministers of various states. Women can be anything they want---lawyers, journalists, business owners, you name it.

In many families, the girls are treated like princesses. I mean, pretty clothes, dance lessons, private school, etc. The old ways of thinking are changing.

It's what you do that matters, not whose Name you do it in.

It's not exclusive to Muslims. It's not exclusive to the Middle East. In secularized, Western countries, yes, womens rights have come a bit farther, but it wasn't really all that long ago when our own courts said that a husband couldn't rape a wife--that those were a woman's marital duties. A lot of the old Testament laws about women are still followed by ultra-conservative Jews today, like the one where if a man finds a virgin and lies with her, he has to pay a bride-price to the father and marry her (Deuteronomy 22:23-27) There are also ultra-conservative Christians who hold to the phrase in the New Testament that tell a woman she must either cover her head or have it shaved (1 Corinthians 11) There are some Catholic schools who pressure teen girls to sign promises of abstinence until marriage (I went to one of those Catholic high schools. Signed that promise. Lost my virginity in a body cavity search.)

The Chinese also have traditions like this, that specify a woman should be a virgin in the marriage bed or she is seen as having dishonored her family. And in the African countries, they take extreme measures by using FGM (aka female circumcision) to ensure that a woman is virgin on her wedding night. It is not specific to one religion or one culture; traditions like this abound all over the world.

Yes, you're right about women in India enjoying a higher status than in most Muslim countries, but treating women like princesses, putting them on a pedestal, is also seen by many women as another form of objectification. They are treated by men as objects; not persons.

Yes, I know women have equal rights in India. My apologies, I apparently didn't make myself clearly understood. I did NOT refer specifically to India by that comment. What I said was:

And part of the reason for the changing status of girls is that men figured out that girls can bring more wealth to their father's family if the girl marries a traditional, conservative man who can afford to pay a higher bride-price. The more wealth, education and status a woman has, the more desirable she could be viewed as a wife and the father could ask for a higher bride-price. Although it is no longer officially practiced today, there are still 'traditional' gifts exchanged between the familes today, though this is more a token to tradition than actual practice.

They still have a way to go, however. This article clip is from October of 2011:

More than 200 Indian girls whose names mean "unwanted" in Marathi have been given a fresh start at a mass renaming ceremony in Maharashtra state. They had been called Nakusha by parents who would have preferred sons. Hundreds of people committed to fighting gender discrimination attended the ceremony in rural Satara district.

Statistics show a continuing preference for boys in India. The gender imbalance has widened every decade since independence in 1947. According to the 2011 census, there were 914 girls for every 1,000 boys under the age of six, compared with 927 for every 1,000 boys in the 2001 census. Female foeticide remains common in India, although sex-selective abortion based on ultrasound scans is illegal. Sons are still seen by many as wage-earners for the future.

Satara, where the ceremony took place, has one of the country's lowest female populations, with 880 females to every 1,000 males, says the BBC's Zubair Ahmed. The local government said it wanted to combat negative attitudes towards girls, who are often seen as a burden by their families because of the dowry that has to be paid when they marry.

The 285 girls at the ceremony ranged in age from one to 20. One 15-year-old chose the new name "Ashmita," meaning "very tough" in Hindi.

A 16-year-old, the youngest of six sisters, said she had chosen her new name with the help of a school friend. "It'll take time for people to get used to my new name. I know people will still call me Nakusha. I want to give them happiness by saying my new name is Kiran."

That may be true, but notice that even in your examples, the violent perpetrators are male. Most of the violence in the world is done by males and females are overwhelmingly the victims. This is true across the world. My Indian friends do not think that females are safe nor treated as equals in their society.

From an earlier article I read, the attack was not on a public bus. The six men lured the couple onto their private bus and then attacked them. The driver was involved and knew what was going to happen. There were no witnesses to the attack except the attackers themselves. They apparently used a metal rod (besides raping her) to penetrate the woman. It ruptured her intestines and caused a massive infection that (probably mercifully) ended up killing her.

I'm no man hater, believe me. But the women of this world need to rise up and protest against all the crimes committed by men. Most countries (especially the U.S.) spend billions to prosecute and incarcerate men. Why should women have to pay for this? And let's not forget that women are many times the victims in these crimes.

What in the world can we do about all this excess testosterone that is corrupting the peaceful existence of women? I'd love to hear some ideas for solutions to this problem. Is it even solvable?

Most of the articles I read said it was on a public bus and the couple were coming home from the movie theater (cinema). there have been conflicting news reports on this topic, as there are on every topic, but 'm sure the actual timeline of events is going to come out in the trials. As for solutions, see my post at 3.1.

Track record of Indian govt, especially when the Gandhi cap wearing Congress rulers come to power is most horrible.

Congress has assembled mostly rapists, criminals, bandits, looters and other types of criminals in its wings. Name the types of criminals, Congress has them all. Many are in key places.

Many are disgraces to be called as human beings.

For this reason, India is one of the most unsafe nation in the world for women.

If there were punishments right in time, these most horrible acts would not be repeating often.

India's first PM, Jawaharlal Nehru was a rape expert; fake from top to bottom with a Gandhi cap; highly arrogant and self centered one with no morals.

Along with him came his Gandhi dynasty. His dynasty members were worse and these days, they are ruling and one can't call them and their Gandhi cap gang members as normal human beings.

Nehru/Gandhi dynasty and gang members have given India one of the most corrupt investigation agencies and the most rotten judicial system. There are many rapist judges and justices right from bottom to the top.

Media dances as they want and has zero credibility.

With hardly five percent convictions rates, these types of rapes have been going on and on all over India.

But talk about: lectures on morals, honesty and so on, Gandhi cap rulers have been experts.

At the same time, human history has not seen such barbaric and beastly rulers as Nehru/Gandhi dynasty ones and their Gandhi cap gang members.

These days an uneducated Italian mafia boss is ruling India. What can you expect with such rulers?

No wonder Mahatma Gandhi wanted Congress party to be dissolved as soon as India got independence.

The trial in this gang rape up will end up as another long drawn trial (of at least a decade plus) or another farce like the most trials!

What these criminals did seem more like an act of vengeance than just rape. They obviously wanted to damage her the most they could. And they didn't bother to cover their crime much, throwing the couple out from the running bus. We usually see sociopaths and very sick individuals but rarely in groups or so open to show their crime.

You're right, Adam, it doesn't say which religion the rapists belonged to, and they could very well have been Muslims or they could all have been atheists for all anyone knows. But since the vast majority of Indians are Hindus, I felt it safe to assume that these rapists were probably also of that religion. It was just an assumption on my part. Happy New Year, Adam.

Where is the news about the victim's male companion??? He was beaten and thrown off of the bus to hell, also. I'm glad that the media and the citizens of New Delhi are keeping this in the spotlight. Hopefully, this young woman's hideous death will not be completely in vain and will bring about some positive change but I'd like to know how the young man is. He is also a victim here and matters just as much as the young lady.

You make a very good point, chefaz. I guess men getting beaten up doesn't count since it's all too common; probably even more common than women getting raped. So they don't consider it news.

I've been waiting to read news of the young man but haven't seen any. After reading about this most heinous assault on this poor couple, have noticed a great deal of other news coming out and none of it good. Amazing the amount of rape cases and how it's handled. Surprising to see in India, at least to me.

On the other hand, what must people in India and other countries think when they read about schools and movie theatres under attack in the US and Chicago's record 500 with the year not yet over.

Like Ponce de Leon's Fountain of Youth, we are still searching for that perfect sect of human beings who are kind, considerate and caring. Maybe they don't exist.

I agree that above all else it is critical that crimes like this are not swept under the rug or lightly regarded. These despicable, horrible, assaults need to be STOPPED and hopefully this case will bring the momentum necessary to do just that so that other women (and men) are not similarly brutalized and/or murdered.

Shifting gears (from the relentless news of human depravity on msnbc)...

    There will always be a small portion of the human population who seeks to have control/power over another human being. In today's day and age when one can start with nothing and wind up a millionaire, after a certain point money ceases to be a goal and the ability to have power over another human being is the ultimate status symbol. And women will almost always be a target of that, as we are generally physically weaker and the way the human body is designed lends to it.

    Individuals will never 'grow out of it'; we as a society have to evolve past acceptance of it. Just as we did slavery and discrimination based on color (mostly), so too must we evolve past acceptance of it. Rape used to be the untalked-about crime; it was only during the mid-80's when we started paying attention to the epidemic of violence against women, and although rape is still underreported, and laws dealing with it are still being fine-tuned, generally we are a lot better in this category than we were a quarter-century ago. The other societies of the world are going to have to evolve, in their own time and their own way, as well.

Like Rosa Park's refused to move on the bus. Or Gandhi, when he decided to make his own cloth,who would eventually help create an independent India, but would later be killed for doing so.

      We see in this horrible incident, an intelligent young woman, maliciously attacked, savagely raped and tortured, then thrown off a moving bus as if she were some piece of garbage. Instead of the gifted medical student, so full of potential, who worked so hard to help make a difference in her country one day.

      Perhaps she will still make a difference in the end. Just not the way she intended to.If rape were to have any face at all, it just might end up being hers in the end.Not some young girl, uneducated, going about her errands.But one who had a male companion, was doing all the right things, as if that really mattered, in the end. For those males who would seek to blame the woman in all cases, foolish as that is to most of the world. This woman also was educated, attending college, a medical student.

      India now is facing a choice, with the whole world watching. Exactly, though, how does one determine the death penalty only for those rare cases of some rapes? Is it determined for a certain number of males involved? Say, four or five? Does one need to use an object to warrant it? If a woman raped is then killed by her family for being raped, for honor, what then?

      Home Minister Sushilkumar Shinde said," Not only to this, but in future also. This one incident has given a greater lesson," Shinde said. He said earlier the government was considering the death penalty for rape in very rare cases."

      Why not just make rape a life sentence mandatory. And death the penalty if the victim is physically beaten or harmed. You can bet the number would drop if men knew those were the consequences they would face.Then again, nothing would change, if police did nothing when rape reports were ignored, or women threatened when they were. You can't alter a mentality that views women worth less then animals.

I think the only reason they're even "charging" anyone is because the rest of the world is watching, in a week when it's all calmed down and most people have forgotten about it, these monsters will be out doing it to someone else.

      Stoning is still practiced in India, though it is illegal and indulging in such can lead to prosecution if caught:

      Police in India say they have arrested eight people for stoning to death a young couple who had a love affair which met with their disapproval. The accused include the parents of the murdered woman, who died alongside her lover. He came from a lower social group in Uttar Pradesh state.

      There have been many cases in India where people have been killed for defying tradition and family honour. Often these crimes are endorsed, or even encouraged, by village elders.In the latest instance, police believe that Rajiv Verma and his girlfriend Renu Pal were stoned to death by a mob of about 200 people, including many of the girl's relatives.

      The officer in charge of the investigation told the BBC that Renu's mother was suspected of playing a leading role in the killings.

      The couple were murdered apparently because of the mob's "shame" that Renu, a student, should fall in love with her teacher, who came from a lower social group or caste. The police said that community leaders had warned the couple to break off their relationship, but three days before their deaths, they ran off together.

      Last month India's Supreme Court warned senior officials that they could be prosecuted if they failed to prevent such killings from taking place.It said that in some cases village councils had encouraged or even ordered the deaths.

        I remember when rape was a capital offense. The rape penalty was decreased (in the late 60s, early70s?) in this country so that rapists would have some reason not to kill their victims.

        According to the article, she was a medical student:

        The 23-year-old medical student, severely beaten, raped and thrown out of a moving bus in New Delhi two weeks ago, had been flown to Singapore in a critical condition by the Indian government on Thursday for specialist treatment.

        And women do have equal rights to men in India, as wiseone specified in his post above at 1.4. At least by law. The practice is still trying to catch up with the legislation, but they are making great strides toward fairness, equality and justice.

        If the crime is so rare, why do we hear about a recent gang rape where the victim chose to commit suicide rather than put up with the incompetent police and court system? What about the government officials and police officers who refused to hunt for the rapists? The mainstream media in this country reports everything, but I seriously doubt we hear about all the crime in India on a daily basis, like we do here.

        Here are some of the stats according to the Press Trust of India in an article dated October 27, 2011:

        Delhi is perhaps the most unsafe city for women as 414 rape cases were reported in the national capital in 2010, the highest among 35 major cities in the country, while Mumbai followed it with 194 such incidents.

        According to government statistics released today, 23 per cent of rape cases in these urban areas took place in Delhi and 10.8 per cent in Mumbai.

        A total of 1,422 kidnapping or abduction of women have taken place in Delhi last year which is 37.7 per cent of the total cases in 35 major cities.

        There were 112 dowry deaths and 1,273 incidents of cruelty by husband or relatives in Delhi last year, said the report of the national Crime Control Bureau.

        In Mumbai, there were 146 incidents of kidnapping of women, 21 dowry deaths and 312 incidents of cruelty by husband or relatives during last year.

        Pune reported third highest number of 91 rape cases in 2010 followed by Jabalpur where 81 rapes took place last year.

        Software city Bangalore recorded 65 incidents of rape while Indore reported 69 incidents of rape last year.

        Among the states, Madhya Pradesh reported the highest number of rape -- 3,135 incidents -- in 2010 followed by West Bengal where 2,311 cases were reported last year.

        Assam, Maharashtra, Uttar Pradesh and Andhra Pradesh reported 1,721, 1,599, 1,563 and 1,362 cases respectively.

        There were 1,012 incidents of rape in Chhattisgarh, 1,025 in Orissa and 795 in Bihar.

        But they are making great strides--the fact that they have these stats at all means that more women are reporting these tragedies, and officials are taking them seriously enough to track and add them to crime statistics. They have come a long way and should be commended and encouraged to continue on the same path.

          It's not that they 'hate' us as much as it is that they are hard-wired to want control and mastery (that testosterone thing) and we happen to be (generally) physically smaller and weaker. It's not about hatred, it's control over someone, something, in a world where things are incresingly out of everyone's control. Women, children, and domestic pets are often the most vulnerable, and therefore the likeliest targets, of that need to control and dominate.

          There is no denying the fact that there is a subset of the male half of the human race that does feel the need to control and dominate others. (There are in the female half too, by the way.) The act of rape is not about sexual satisfaction, but of power and control.

          I volunteer at an inner-city animal shelter, and I cannot tell you how many times a pet has been removed from a home in which domestic violence has occurred--right along with the women and children. We've had women come in to surrender a pet saying they are going to a womens' shelter and can't take their pet with them. In every one of these cases the opet exhbits a fear reaction to male figures.

          Can't think of any country in the world, including the US, where women have cultural or financial equality. Shirley Chisolm, one of the US's early congresswomen was asked in the 80's which was more of a political impediment, being black or being female. Her response? Being female. Black men were given the vote decades before women were in this country. We elected a black president before we elected a female one (note that both India and Pakistan have have had elected female heads of state) How many women do you see at night taking a solitary stroll around your neighborhood- without a large dog for protection?

          We have a long, long way to go for gender equality before we can sneer at how "backwards" other nations are. But we seem to be making slow progress, both nationally and world-wide. Keep the momentum going the right correct direction. Just say "no" to religious and political leaders who want to "keep women in their places." We've been there far too long already!

            India itself needs to share a little blame here. This is a culture, after all, that for centuries has sanctioned abandoning and even murdering newborn baby girls because they are deemed not as valuable to the family as baby boys.

            That being said, why did no one else on the bus try to stop this? Where was the driver? He should be charged as an accomplice, as well as people who did not help. They are just as complicit in her death as the killers.

If these DEMOCRACIES CANNOT ensure these basic needs, they can call themselves as AUTOCRATIC REGIMES or LAWLESS, IN HUMAN REGIMES, AUTHORITARIANISM REGIME, TOTALITARIANISM REGIME or anything OTHER THAN DEMOCRACY like it exists in some parts of AFRICA, PAKISTAN, AFGHANISTAN or the MIDDLE EAST.
