A man linked by officials to the attack on the U.S. consulate in Benghazi has been conditionally released by a Tunisian judge, an adviser to Tunisia's justice minister said Tuesday.
The adviser, Kamel Ben-Jaballah, told NBC News that Ali Harzi, 26, was released from custody by the investigative judge yesterday.
Harzi, however, remains "technically under investigation" and his release is "temporary," Ben-Jaballah said, adding that Harzi is subject to a travel ban that forbids him from leaving greater Tunis.

Harzi's lawyer said that his client, who is Tunisian, was released for lack of evidence.
Harzi's release appears to be a setback to the investigation of the Sept. 11 attack on the consulate that killed four Americans, including Ambassador Christopher Stevens, information management officer Sean Smith and security personnel Tyrone Woods and Glen Doherty.
The investigation in Libya has been stalled due to the weak central government in the face of the powerful militias, some of which may have been involved in the attack.
An independent panel's report on the Benghazi diplomatic mission attacks cites management failures at senior levels in Washington that resulted in "grossly inadequate" security. NBC's Andrea Mitchell reports.
Harzi was one of very few people in custody in relation to the attack. U.S. officials told NBC News in December that Egypt had also arrested a member of the group Islamic Jihad for possible links to the attack, but in general they lamented a lack of cooperation from local governments in their investigation and said most suspects remained free.
The attack became a political bombshell in the United States, with critics of President Barack Obama's administration saying that more should have been done to protect the embassy, particularly after officials had requested extra security.
A scathing report cited "systemic failures" within the State Department and was at least partially responsible for the resignation of the assistant secretary of state for the Bureau of Diplomatic Security. Three other officials were relieved from duty after the report was released.
Harzi's lawyer, Anwar Oued-Ali, said the presiding judge had "conditionally freed" his client Monday night and that he must remain nearby in case he is needed. The lawyer described the release as "correcting an irregular situation" because, he claimed, authorities never had any real evidence.

Harzi was originally detained in Turkey, and in October was extradited to Tunisia, where authorities had said he was "strongly suspected" of being involved in the attack. His lawyer said he was officially charged with "membership of a terrorist organization," a charge punishable by six to 12 years in prison.
In December, FBI officials questioned Harzi for three hours in the presence of a Tunisian judge.

It's good they could release him until all the facts have been gathered. I hate to see people being held before concrete evidence calls for diferently. Hopefully they can find out all the facts, and bring them to light.

Chris, there are only a couple of reasons that the "suspect" was released, both are bad. #1 The judge is corrupt or at the mercy of the Islamic radicals or......#2 This "suspect" will be eliminated shortly after release......QED
I wonder if Secretary of State Clinton is well enough to share her thoughts on this matter. Or perhaps she would like to stay with the whole "spontaneous demonstration" no one can be faulted line.
I seriously doubt that anyone will be held responsible in a court of law for the attack and murders in Benghazi. Between the judges being in fear of the militants and any potential witnesses being in fear for their lives if they testify, the odds are that no one will see prison time over this. Whether or not there is any street justice carried out is a different story. Ambassador Stevens was pretty well liked and respected by a large number of Libyans, so I would not be too surprised if those responsible for his death ended up dead in an alley somewhere.
Chris--your brain cells are gone. Obama wants this guy to disappear. Tunisia had this guy in custody and Obama administration claimed they could not get access to him, but Senator Lindsey Graham made one phone call and got access right away. The guy will disappear or strangely killed by an Obama Drone. Go figure.

I have not been drinking, I was just glad this man has a shot at a fair and just trial, and is not being held on weak evidence. We should all be praising that, it's not often seen in that part of the world. I believe that Obama wants to get at the truth just as much as the rest of us do. I'm sure they have ways of tracking him, and keeping him safe until the trial. People here have no faith.

What Chirs150 is referring to is actually something that is protected by the Bill of Rights for U.S. citizens. It's interesting to see people attacking him for wishing others the same level of protection. It is that mentality that is allowing our own government to to routinely piss on our constitution through recent versions of the NDAA, the Patriot Act and various actions of Homeland Security.

I have doubts that they ever had any intention of convicting anyone this was all just a show to buy time to get their money from Obama, now the matter will be put to rest for lack of evidence, remember there is no crime committed when the killers are Muslim and the victims are anything but, besides there were no witnesses and no proof that any of the suspects had anything to do with anything, they were all just tourist with bad timing to sight see the popular US Facility. it was all just a bad day especially for the poor guy from Tunisia to have traveled all that distance just to look upon the embassy and have someone blow it up right in his face just as he got there what a shame.
This case is never going to see the light of day. Our president doesn't want to see this case go anywhere and I wouldn't be surprised if he had a hand in having this guy released and this case squashed. You've just witnessed the last you'll probably ever hear or see of this case again.
If it was over a crime commited by a Christain against a Muslim like a insult or something the exicution would have already taken place, its a good system that way Muslims don't have to sit in the same room and breath the unclean air used by a christain during the trial. it also makes for a speedy trial as the defense really doesnt have to show up and waste time making a case. and it also keeps the Muslims free to do their prayers. there really isnt much time in Islam for trials, you would not want to miss a call to prayer that could cause searious complications for you and your family.
I understand that the suspect released has been restricted to the bounderies of Tunisia proper, that should make him easy to find when they decide to have a trial in Bengazi Libya, its nice to see that these countries can cooperate so well, they are even better then here in the US the police here tell you don't leave town. I think they could be honest with everyone and just admit that they have no intention of bringing their holy warriors to trial when they can find some scapegoats to hang latter. reminds me of Iran, just a little more time, just a little more time. do you know what happens when the camel gets his nose in the tent?

But, why I am not surprised? The whole Benghazi affair stinks to high heaven. The attack on the embassy was well planned and executed by the attackers, our government turned its head away, the Libyan government made a token effort in hunting them down, the attackers, then a possible suspect was “too hot” for Turkey to handle so they passed him over to Tunisia and now a Tunisian judge gives the suspect a pat on the back and lets him go!
The only thing that remains is for the Norwegians to award all involved in the Benghazi attack, the Nobel Peace Prize. That would surely top the cake!
No surprises here. Of course they released one of their own. Does anyone remember the song called "The Night The Lights Went Out In Georgia" It was about systemic corruption in Georgia well replace Georgia with the word Libya and you get the idea. America blew it from day one with the Libya thing. Only the people on the ground did the right thing. This like everything else will NEVER be resolved in a just way because too many powerful people do not want it resolved. I still remember that the CIA officer on the ground sent a blue stripe right to the President. There was 8 hours of fighting when according to another interview, with Fred W. If, and that is a big IF, Mrs. Clinton testifies before Congress on Benghazi, the reason she will have no knowledge of the ATTACK BY TERRORISTS is because one of the prime suspects was released before obtaining any evidence on what happened.
Maybe Mrs. Clinton can at least explain why she did not appear on National TV instead of Ambassador Rice who blamed "someone" (NOT Terrorists) from a non-existence demonstration. I hope she doesn't use her previous line "I was too tired to make a statement".

Hillary needs to come to the congress and explain things. I, at first, thought she was using illness as some sort of avoidance tactic, but can see that she really was ill (No one would fake a blood clot.) I am glad she wasn't doing that, but she really does need to speak to congress about what happened because it may taint her 2016 run for president. Surly she would not want this dogging her. Better to straighten it out now.

I think that level of "unprecedented cooperation" from our allies probably rises and falls by the $$$$$ in funding they receive. It seems this administration would like for this problem to just evaporate.

The Department of State, which falls under the executive branch of the U.S. Government, is the country's chief foreign-affairs agency. It provides assistance and advice to the president, works with Congress, and protects U.S. citizens abroad.
Don't you believe there should be any concern over a scathing report citing "systemic failures" within the State Department? Don't you believe anyone should be held responsible for those very failures that cost American lives?

Wow....paid by Saudi Royal family....what exactly does the Saudi Royal Family have to gain by attacks on US consulates in the region. Saudi has prospered quite nicely but their relationship to America...it isn't likely that they are willing to walk away from the synergy any time soon. If the ME continues too much farther over the abyss the Royal Family stands to loose there status and position in the region to Iran. Once that is gone so is Kuwait, UAE and a few others that will not withstand the tyranny that will run through the ME and Africa.

When they arrested him instead of involving the CIA in it, I posted that he would be released probably into house arrest or some condition of that sort after a few months. I accused the Tunisian government of only arresting him to protect him from the CIA, other Americans, or drone strikes, like what happened with Anwar al-Aulaqi. The response I got from commenters was that I'm a loony and conspiracy theorist and that Ali Harzi would be handed over to the CIA. Well I may still be loony, but sometimes that's what it takes to understand how governments that hate the U.S.A. to the core function.

How come this is acceptable, it is not for me or the families that lost loved ones. There is no Urgency for anything other than Obama care, Budget nope, Benghazi nope, Change nope. However there is urgency for trips to Hawaii and all of the presidents family to sleep over in the White House.

I would like to see a list published of all the millions, and billions we pay each country and what - purportedly- the money is for, air bases, hush money, etc. How much are we paying Egypt? How much are we paying Pakistan? How much are we paying Japan, how are we paying Syria? If this list was published and the American people could vote their approval or disapproval on each country, do you think this kind of crap would continue? Do you think they would/ will continue to get paid after Pakistan hid Bin Laden? Tunisia after it released the bombing suspect? Once they find out we keep paying no matter what they do, How much will they demand, and when will we meet their demands?

Musician- That is the way it works here and it is good for the most part. However, in other countries it dose not work that way. For the most part in Tunisia and similar countries when someone is released it means that either the right people were paid off or you have the right friends to put pressure on the authorities. That is just the way it works.
I apologize for disillusioning your world view but not every justice system in the world is like ours. Most are very corrupt. I had to learn that the hard way in my travels. When not in the U.S. always keep money stashed for encounters with local authorities.
