According to Muslim Shari'a law, the husband who accuses a wife of infidelity must swear in god's name he is telling the truth, then either produce four witnesses (male or female) who will swear in God's name that they saw the act of penetration.

That's an interesting observation, as I read a few days ago that the court find not a single attorney anywhere that would take their case. I believe this one is one is the equivalent of one of our Supreme Court justices or Federal Court justices who had to step down in order to take the case.

It could be that you are correct, and his statement is deliberately outrageous to make even the criminal element see that this type of thing cannot be condoned any more, especially if India is to attract foreign investment and business.

At any rate, this attorney is not "just" an attorney, and I believe he has an ulterior motive in making this statement.

Please consider that as long as women are not protected under the law, they have to protect themselves in any way they can. They are not paid equally, and truthfully are not represented by the Constitution. They are given a raw deal from birth. If a woman doesn't want to have a kid, it is likely that the many social injustices she has suffered she would not wish on another person.

Fix the Constitution. Allow women to stand up for themselves and be the force they can be. Pay women a fair wage. Make the punishment for rape be so egregious that no guy dares it. See how many fewer abortions ensue.

When we see a news story like this we tend to try to rationalize the nature of the story in western terms. That is a huge mistake that needs to be realized. Even in India, there is a diverse population that is heavily influenced by Islam. Go to the Indian news sites to read how this type of physical assaults take place all the time and the constant excuse is that these women ask to be assaulted because they are "loose" women by the standards set by Islam and the Koran. In their culture woman are property to do with as they please. They sell their daughters to older men. Drac: The burqa is the least of the problems women have to face in those countries. In India, because male children are more valuable to the parents, the educate the males, and seldom the females (unless it's a missionary school), and on many cases, girl babies are abandoned, especially in poor families. One of the reasons is that girls are supposed to bring a dowry with them when they get married, as opposed to the Lobolo in South Africa, which is a gift the groom gives to the family of the bride (bride price) to compensate them for the loss of a valued family member. Poor families cannot afford a good dowry to get the girl married higher up in society, even if they could break through the caste mentality. As long as you have society with customs that the female's family pays you to take their daughter, you can't fix the anti-woman mentality. I do believe that the US should get involved - not in this trial, but in India's safety issue for women, and tell India that if they want foreign aid, they have to do better.

Incidentally, a friend of mine (American) wore a burqa in Afghanistan when she lived there with her Afghan husband and she said it wasn't as bad as people think. Because you're covered, you can wear whatever you want under it, and it's not as heavy as you think.

Not disagreeing, but there is no way that we can live by old testament law. The largest harm is done by the people that are NOT caught - those that are still secret - and by old testament law - unpunished.

The same could be said for the scarlet letter - sure - it stands out - but what of all of those that are doing the same deed that are not caught?

Glass houses and stones. I have my skeletons in my closet just like ALL of us do. Were my dalliances to become public, no doubt I would be as a minimum embarrassed, if not in jail. I try not to think of anyone as being more screwed up or less screwed up than I am - I am a model citizen in public - in private - well.... And that is NO different than ANYONE else - those that deviate TOO far (and are caught anyway) are punished and held up to public scrutiny.

We have laws against cruel and unusual punishment here. I am all for life without parole for a pedophile conviction, and I'm all for the death penalty for a pedophile conviction. But if you give that penalty for the conviction, the first thing that's going to happen is it will be appealed due to the cruel and unusual punishment. That is IF that penalty even gets to the point where it's considered. No matter how much you revile these people, if the penalty is successfully appealed, then their conviction will be up to some judge who may decide to let him be paroled. Many pedophile, murderer, rapist etc lose their families when they commit the crime - so that is sentencing THEM if they have to take care of the POS. These people need to be given sentences that keep them out of the general population - be it life in prison without parole, or death. But they also need to have the law read that life in prison without the possibility of parole means no parole even if the prison is over crowded or the budget gets cut.
