The only all-girl band in India’s troubled Kashmir region has split up after a controversial Muslim cleric issued a fatwa against them.
However, the cleric -- Grand Mufti Bashiruddin Ahmad – is now facing a backlash with a leading human-rights lawyer planning to take him to court over his claim that the band, Pragaash, was un-Islamic and other pronouncements.
After the fatwa, the three teenage girls received online threats prompting police to arrest three people, according to several reports including one by BBC News.
Omar Abdullah, chief minister of Jammu and Kashmir, said on Twitter that he was “glad” that arrests had been made.
In an interview with India’s NDTV, a band member named as Aneeka, who is still in high school, insisted that “nothing has forced us to quit.”
“We quit for the happiness of our people. As the grand mufti said, it is un-Islamic ... that’s why we quit,” she said. NDTV pixilated her face when the interview was broadcast.
“Mufti … is a saint. He knows about our religion and must be respected,” Aneeka added.
'They feel very harassed'
However, for human rights lawyer Parvez Imroz, of the Jammu & Kashmir Coalition of Civil Society, the fatwa against Pragaash was the last straw and he is now planning to take Ahmad to court.
“The lives of these girls were threatened. They feel very harassed,” he said.
Imroz, who is Muslim, said the grand mufti had appointed himself to the role and set up his own “supreme court.”
Ahmad's comments about Pragaash were the latest in a number of “very controversial” fatwas over the last few years, Imroz said, including calling for Americans to leave Kashmir and for Christians to appear in his court.
“We are filing the case because he’s claiming to be some ‘grand mufti.’ Under no law is there any such title,” the lawyer said. “Kashmir is very tolerant. Music … is part of our culture. These girls, they have a right to do it, but I’m telling you we are raising the bigger question about this institution in the society, this self-appointed priest and mufti who has been giving a very reactionary … view of Islam.”
Imroz said he wanted the court to rule that Ahmad had no legal standing, describing him as a “non-entity.”
Kashmir is claimed by India and Pakistan, which have fought two wars over the region. It is the only state in India where the majority of people are Muslims.
In comments posted on NDTV’s website, some expressed their anger at the criticism of the band.
“We're heading in prehistoric era thanks to morons,” one said.
“It's really disheartening to see such narrow views are still being propagated in the country,” another added.

Kashmir has always been part of India but Muslim Pakistan always wanted it and has been trying to get it since 1947. Getting way off the topic of these girls in Pakistan here, but just had to fact check you here. Obama did not go public with the legal justification for the drone strikes. In fact, his administration has fought every FOIA request and every Senate or House request to release these memos. The white paper that is making the rounds this week was leaked, and the white house is already making rumblings about trying to identify and prosecute the leaker. Oh, and the memo that was leaked makes it clear that's there is an even "more secret" memo out there on this topic.
As far as playing the "who started" it game, it's about as productive as when my 3 and 5 year old do it. But beyond that, be aware that drone strikes under Obama's first 4 years outnumbered Bush's 8 years by a ratio of 5 to 1. And what makes that even more striking is that Obama's drone strikes occurred largely AFTER the wind down of combat operations in Iraq and the scale down in Afghanistan. In other words, Bush's drone stikes were largely, if not entirely, in support of combat operations on active battlefields, whereas Obama's are targeted assassinations, and substantially more often in countries where we have no other military presence, such as Yemen. Comparing the two drone programs is apples to oranges.

What most people, including Michael, fail to notice is that Islam which is younger than Christianity, seems to be going through the same evolutionary cycle that Christianity went through. It started out as a relatively peaceful movement and is going through it's violent period as did Christianity (The Crusades, The Inquisition, Papal armies etc. etc.) Heck, Christianity took over the Roman Empire. It did eventually grow out of that infantile state. One really has to wonder if Islam will grow out of it's violent stage given the downright refusal of the supposedly peaceful majority of mainstream Islam to rise up and soundly smite the violent ones that are giving their religion a bad name. In view of this, I have to think that way deep down inside, all followers of Islam would like to see some form of Islamic rule and law across the face of the Earth even if it's done through violent means. All of this discussion about religions just reaffirms something I realized a long time ago......Religions are like farts. Yours is ok but everyone elses stinks. So, keep your religions to yourselves because from my point of view they all stink and I don't think anyone really wants to smell them. Keep it in your place of worship where it belongs.
The best way to fight violent intolerance is to overwhelm it. You can issue a fatwa against one all-girl band, but if there are 100 of them, it becomes a lot harder to suppress them with threats of violence.
Unfortunately, there are probably a lot more basic, fundamental rights that the women of Kashmir need than this. But you have to start somewhere.

Christianity started out as a "religion of peace" and went through years of war trying to capture Judea and Palestine from Muslim rule, using total war to accomplish their goals as ruler of terror. Now Christianity has settled down and Islam as taken its place as ruler of terror, claiming its "Religion of peace". All the wars may not have been caused by religion, but religion escalates the conflict drastically.

There are many who believe that these girls should have the right to have this band and that women in general should have the right to do what they want in the Muslim countries. We shake our fingers at them, look down our noses at them and in general consider them to be be criminally stupid.

I've always believed that in America, the land of freedom and liberty, people should be able to do what they want to do as long as they aren't hurting someone else. That would be true freedom. The problem is that America doesn't work like this. We have our freedoms filtered through religions ... namely Christianity as well as other personal beliefs.
As an example ... but not the only one ... there shouldn't even be a discussion about gay marriage. It should just happen because it hurts no one and people here should be free to do what they want to do. Sadly, its religion that causes such an uproar about it. There are other examples you could think of where we simply can't do something because of moral choices even if no one gets hurt and our freedoms are subject to whatever moral choices are popular at the time.
Yes, its sad that these girls can't do what they want and its also sad that in Islamic countries, women are treated like garbage. While America isn't no where near as bad, we do have the same problems when it comes to people really being free. While I fully support freedom of religion, I also look for the day when I can be free FROM religion. Until then, the words freedom and liberty mean little in America.

The majority of the countries realize what century we are living in, and are striving to better themselves.
Yes there are exceptions to everything, but overall, the western world, as it is called, believe that most people have certain rights. The Muslim religion doesn't work that way, it's only a few that have rights, and women aren't part of that.

Ok so I assume you are talking about human rights? Because I think you’ll find many Muslims are very modern in their thinking. Take for example terrorism; Muslims have been very modern in their approach to terrorism, taking it out of then national setting (so national liberation groups like the IRA) and moving it into the international arena in a fashion, very much akin to a modern international company.
Furthermore, if we look at Muslim extremist and their tendency for Koranic literalism, we find that it (much like biblical realism) this is a trend that has its origins in the 20th century (early 20th for Christians, late 20th for Muslims) so again it would appear they are living in the 21st.
Finally I would say that the idea of resisting western cultural influence (human rights being a big example of Western Culture) is again a product of the 20th century and thus not reflective of a 500 year old out-look. In particular this revulsion of human rights by Islamic countries, seems to be a cross between Marxist theory (which basically equates Human Rights, with the cultural dominance of the ruling class) and ridged Islamic thought that condemns other religions.
