Lead detective in Oscar Pistorius case faces attempted murder charges

Attempted murder charges against investigating officer Hilton Botha were reinstated Wednesday.

PRETORIA, South Africa -- The lead detective in Olympic sprinter Oscar Pistorius' murder case is himself facing attempted murder charges for opening fire on a minibus containing seven people in 2011, South African police said Thursday.

Hilton Botha, who took the stand against Pistorius at the Paralympic gold medalist's bail hearing this week, is due to appear in court in May, police spokesman Brigadier Neville Malila said.

"Botha and two other policemen allegedly tried to stop a minibus taxi with seven people. They fired shots," Malila told Reuters.

The charges were provisionally withdrawn, but were reinstated on Wednesday - at the behest of the state prosecutor - after Botha had taken the stand against Pistorius in Pretoria's main magistrates court, he added.

The prosecution is challenging Oscar Pistorius' testimony about what happened on the night his girlfriend, Reeva Steenkamp was killed. NBC's Michelle Kosinski reports.

"We were informed yesterday that the charges will be re-instated," Malila said. "At this stage there are no plans to take him off the Pistorius case."

It was unclear why the charges were reinstated against Botha, or how the latest twist in Pistorius' sensational four-day bail hearing will affect the athlete's chances of securing release from custody pending his main trial.

Pistorius - a double amputee dubbed "Blade Runner" because of his carbon fiber racing blades - faces life in prison if convicted of premeditated murder over the shooting of his girlfriend.

South African media said that since the charges were not hanging over Botha when he was in the witness stand, the revelations about attempted murder charges were unlikely to mean his testimony would have to be withdrawn.

The new twist caps an ignominious 24 hours for South Africa's prosecution service.

Under cross-examination at the bail hearing on Wednesday, Botha was accused of contaminating the crime scene in Pistorius' house and had to backtrack on details such as the distance of witnesses from the athlete's home.

Lead defense counsel Barry Roux accused the police of oversights and slip-ups in their initial investigation.

Pistorius is accused of shooting dead his girlfriend Reeva Steenkamp, 29, at his home early on Valentine's Day.

hey folks they are working hard to (fix ) this, before you know it , this will not be murder, but the gun (accidentally) went off 4 times. and he walks, cause the cops did a (bad ) investigation. who says money can't buy happiness. ?

The most critical testimony is the angle of he wounds the woman suffered. He told cops he was on hi stumps when he shot into the bathroom and they say the angle of the wounds suggest he had on his blades when he shot through the door. Anothe thing was his holster was beside the side of the bed where she was supposed to be asleep so if he got the gun and dropped the holster he had to know she was not in the bed as he says he thought. But after all this is SA and anything can be bought there if you are the right color an rich.

They will find every loop hole in the world to get him off. and the poor gal who loved him will fall by the wayside and be forgotten for forever. The only thing that will set him free is if the jury are idiots! If they listen to all these things that don't make any difference then he will get off. What is all this talk about being rich and the right color to get off. OJ got off and he is black and rich. Crazy comments. He is guilty as far as im concerned. Who fires 4 shots into a closed door without knowing who is in there, didn't check to see if his girlfriend was in bed before he left the room, got the gun from her side of the bed, went without his legs and yells to her from another room to call for help. Why wouldn't you wake her to the danger and tell her to call for help? There are too many holes. He is making up anything to try and save his hide. He is a cold blooded killer. I bet an X girlfriend or someone else could tell you he has a very bad temper or something. Maybe he is not used to people telling him no. Either way he did it!

    It seems that OPs' "story" changes every day. It seems that now, we the public, are expected to believe that OP is the VICTIM, and we should feel sorry for him. Maybe his family's money can buy him a private room and shower. I do not believe any of his multiple stories.

    Just a bit of worthless trivia sensationalized by NBC which is siding with OP and helping concoct a case in the public eye for him. There was no need to say that the charges were reinstated right after "Botha took the stand", implying that they related somehow to his credibility or competency as an investigator. This sounds similar to NBC"s cutting of the tape to the 911 call in the Martin case so as to falsely damn Zimmerman in the public eye.

    in the hallway leading to the bathroom and the other three were found outside the bathroom door. Sounds like she was shot at while in the hallway, before running into the bathroom and locking the door. If true, so much for mistaken identity.

      First, let me say that I tend to think that Pistorius did it, so I am not defending him, but rather, just raising the fact that the case may have already been tainted, and the cops are looking like major idiots so far.

      Did you hear the testimony of Botha yesterday regarding the angles? He said that he is not a forensic investigator. Based on that, and the fact that the medication they found, and thought to be testosterone, not being testosterone, they are looking like bumbling fools. Also the witnesses to the sounds being 1800 feet away did not help them look any better.

      If this keeps up, Pistorius may walk...pun intended.

      Why are u idiots still bringing up the O J, case here. It was never proven O J was at the scene but in this case Piss was known to have been at the scene. So these cases are as different as day is to night. The real crime here is a cop with half black GENES named after one of the most racist murderous dictators in the world, Peter Botha, THATS THE most embarrassing story here. With a name like Botha, it's a wonder that he didn't not only shoot at the bus filled with people but also go poison their drinks when they got to their destination

      No Chief, just like in the OJ case, it's the cop's story that keeps changing. Just like in the OJ case it seems as the cops may have screwed the pooch while collecting evidence and witness statements. If OP was sleeping it may be that things are somewhat hazy to him. Have you ever delt with an intruder in your home while you were there and awoken due to them. Well I have and damn near shot the person but I held back due to them fleeing as they heard me rack my pump shotgun. Trust me things get pretty hazy when you come out of a sleep and have to deal with a high energy situation like this.

      Now I'm not saying OP is innocent or did not do it, but I will not find him guilty like many others here just due to a sketchy police report and MSM article. Look at how many here were saying hang the Hutaree group due to the FBI lying and fabricating evidence. The Judge even reprimanded the FBI in that case. Now again I don't support the Hutarees but just using them as an example. It may be you or a family member that get the run through from the cops someday, I'm sure you would want people to give you due process and the benifit of doubt

      PS I use the OJ case here due to other's bringing it up along with the cops screwing the pooch and contaminating the crime scene along with possibly fabricating evidence. Nevermind that the cop pictured looks somewhat like OJ

      There are NO fair trials in the court of public opinion. People charged and found innocent never live down the charge if their innocence isn't broadly accepted, those found guilty but who convince a broad majority of their innocence stand a good chance of being able to perpetually fight the charges against them while remaining free. Money talks, BS walks and a rich BS'r will always get away with it.

      It may not rise to the level of murder, but one has only to look at the apparent lack of prosecution in our country of those individuals, working as bankers, brokers, etc. in the financial industry who have not, and never will be, prosecuted for robbing entire generations of vast amounts of money.

      It seems to be ever more clear that this world is in free-fall so far as organized civilizations are concerned. The effort to level the playing field, to make sure that there is at least an attempt to treat everyone fairly, that those who have, do not climb over the bodies of the vanquished to assume the throne free of any threat of prosecution, is on the brink of utter failure.

          Say what you will to defend OP. Fact is when the first shot fired the girlfriend would have screamed.

          Not sure who is defending him but he has not been proven quilty. Plus in regards to the scream. Have you ever fired a gun insiide of a closed space without muffs or plugs? Very well his ears could have been ringing and/or he could have also fired off several quick shots- cops do it all the time(actually they usually stop when the clip is empty) There is no way to know all of the variables. You also need to understand that South Africa has a very high crime rate, thus may be the reason he armed himself. Try running around your house on your knees, then imagine how you would feel if you thought there was an intruder. Again I'm not saying this is the case but it could have been. Look how many times cops in the US have shot a family member thinking they were an intruder, unfortunetly it happens. Did you scream that they need to be hung up or drawn and quartered?

          It is either a tragic mistake or murder but I'm not the all high and mighty like many of you, I try to look at what might have been. I also feel his money should not matter, but like in the US it will buy the best lawyers and maybe even afford some greased palms.

          Well, he's not. This is just a preliminary hearing to decide what he will be prosecuted for and to decide about bail, etc, NOT the full hearing. I'm sure that the police will be getting evidence from ballistics experts that can tell them about the angles, etc, in due course, and that it will be part of the PROPER trial. In the meantime, what he has done is laid out what HE believes happened. That is all.

          Based on that, and the fact that the medication they found, and thought to be testosterone, not being testosterone, they are looking like bumbling fools.

          We don't know how the boxes or whatever was containing it were marked. Admittedly, they don't look particularly good as they may have jumped to conclusions. I don't think this invalidates anything else though.

          Also the witnesses to the sounds being 1800 feet away did not help them look any better.

          I thought they were 1000 ft away? And it was ONE of the witnesses, NOT all of them.

                  The fact that the lead detective in Pistorius' case is now facing murder charges that have been reinstated is an issue. That alone is grounds for a mistrial.

                  I would love to know if anyone asked him if he had anything for Valentines day for her. It was the morning of it so I am sure if he loved her as he claims he would have certainly had a gift, if just candy for her. If not and he has no proof of dinner reservations or a show or whatever then this shows he had no reason to as he already knew she would not be needing anything. May not be the smoking gun but goes along way to show his character and frame of mind. He has been with her for 8 Months, a "Top 100 sexiest women" voted for two years in a row, first Val..Day together, you know he has to pop for something big. But nothing!!! I don't think so. Someone ask him.

                    Disgusting. To think, this man killed his girlfriend in a fit of rage and is being set up for probation yet a woman kills a man in self defense and gets a life sentence. Gender bias is real. The caste system is still alive and you better believe that racism still exists (though I am not saying that any of this is related to race at all.)

                    Hey NBC News, glad you finally started reporting up to date news. This info was available before Wednesday evening broadcast where you only reported on the prosecution's side of the case. In fact, the entire cross examination of the detective was available hours before your's reporters on-camera piece. I know she is hot looking, but I want entertainment, Entertainment Tonight and the Hollywood Insider can take care of that. John Chancellor and David Brinkley are not happy souls this evening. The 90 second filler has become more important than reporting the whole story?

                          I say so what that the detective has charges of his own he's facing. Obviously it wasn't considered serious enough to suspend him and so he's still on the job. Also police sometimes get into extreme situations. A bus full of 7 people could be a polite way to describe a getaway vehicle for a diamond heist. Point being that sometimes cops have a duty to fire at a bus full of people and until all the details are known it means nothing. Doesn't change the fact that Oscar murdered his defenseless girlfriend in cold blood. I'll buy that it wasn't premeditated but regardless he still wrecklessly took the life of his girlfriend thru irresposible use of a weapon capable of deadly force. Just because you can honestly admit it was a mistake you don't get to use "Oops, I didn't mean to kill her" as a defense and walk away with a slap on the wrist. Just because he made accomplishments nobody else had...yet, doesn't exonerate him from being held accountable for his actions. The depths of his family's pockets shouldn't matter in this, if that ends up being the case it'll be yet another widening of the gap between the wealthy elite and the other 98% of the world.

                          OHHHHHH how right so many of you are, I can't give details but let's just say, I was a hard working class mother, as well as my husband. We made it by but definately not rich... My children killed by a rich very rich man on drugs... Man walks, my reason given to me, "oversights in prosecution." My family wiped out in an instant, two beautiful lives robbed from this earth. Rich druggy never even got a ticket. SHAME SHAME on every person whom ever takes a dime to look in another direction. There will be a judgement for all of these people someday which no money will ever buy them out of.

                            I dont' see how this investigator being charged with a crime has anything to do with the case. Are they trying to say he shot this girl through the bathroom door 4 times and was fighting with her? I don't think so, so that changes NONE of the facts so all of you complaining that he is going to get off is part of the problem. He will get off if someone is easily sidetracked but this still has nothing to do with the FACTS. He will not get off, he was the only one in the house he said he shot her and its obvious that he was not REALLY thinking it was an intruder. If he could get out of it that easy everyone would say the same thing and many people do. Africa is a different country so we don't know what all evidence they can show and how it works over there. His lawyers are doing their job right now trying to discredit the prosecution which is discgusting but they are trying to cloud the issue and the defense is trying to get their info out too. I would say they are allowed to throw out more bull then I have seen in other cases. He is toast!

                              What they are trying to do is taint the jury pool as well as smearing the cop's reputation. All you have to do is look at the OJ Simpson case to see where this case is heading.                                 Please do not insult africans. African Americans in the US claim discrimination because they live in a place that hates black people.

                                If you were referring to the fact that this is happening in South Africa, and that South Africa also has a reputation for hating blacks, then you may have a slight point. However, he would be complaining that it is because he is black, not because he is african. You wouldn't understand the distinction. In many ways, the South Africa of yesterday has a lot in common with the US when it comes to the level of disdain and hatred for blacks. Did you know that the decision to release Nelson Mandela from prison had to be approved by the US government? And that Dick Cheney actually voted against the release of Nelson Mandela? If Nelson Mandela is not a friend of Dick Cheney, now you understand why.

                                I understand how you feel about blacks. However, believe me, all blacks are not stupid and lazy.

                                Piss, may not be black but he is Afrikaner, who are the descented of the Boors (White European Dutch) and they are the minority race there. So, yes he can claim racial discrimination even though these Afrikaners are still a powerful political group there and still holds some of the most powerful positions

                                      It is wonderfull ... so beautiful to watch justice in montion. Never in my wildest dreams would I have ever imagin that a criminal's guilt would be decided based on an entirely unrelated incident involving a law enforcement person that happen sometime in the pass. "Yes sir, you are free to go because that person, sitting in the back of the court room, said or did something stupid a few years ago."

                                        I'm glad this cat set aside his hurt & pain for the moment & focus on protecting his own Life the D.A. & Co. is about to destroy! Now through his own independent investigation we will see there's a conspiricy out to personally get him!

I remember years back when Casino Mogal Steve Wynn's daughter got kidnapped, Metro(Vegas Police) were useless! but when he sent out his OWN security, they found her safe & unharmed, the kidnappers were never heard from again (there's a few of holes in the vegas desert that were filled that week) which means, He'll find out who's out to screw him & expose the ones that are! maybey there are some holes in the African Jungle that need to be filled with crooked politicians, lawyers, judges, etc in the name of Justice to reclaim his name, freedom & innocence! wink!~
