Bin Laden son-in-law arrested, whisked to NYC on terror charges

Officials tell NBC News he had been a prisoner in Iran for most of the past decade and is scheduled to appear in federal court Friday. NBC's Brian Williams reports.

Osama bin Laden's son-in-law, who acted as a spokesman for al-Qaida, has been apprehended, transported to New York and charged with conspiracy to kill Americans, according to court documents unsealed Thursday.

Sulaiman Abu Ghaith appeared alongside bin Laden in a 2001 video in which they took responsibility for the 9/11 attacks and warned of more, before he dropped out of sight for more than a decade before his arrest.

"I commend our CIA and FBI, our allies in Jordan, and President Obama for their capture of al-Qaida spokesman Sulaiman Abu Ghaith," said Rep. Peter King, R-N.Y., a member of the Homeland Security Committee, who first announced the news. 



"I trust he received a vigorous interrogation, and will face swift and certain justice," added King, who is also chairman of the Sub-Committee on Counterterrorism and Intelligence.

Prosecutors say from at least May 2001 to around 2002, Abu Ghaith served alongside bin Laden, appearing with him and his then-deputy Ayman al-Zawahiri, speaking on behalf of the terrorist organization and in support of its mission, and warning that attacks similar to those of September 11, 2001 would continue.

The government says around May 2001, Abu Ghaith urged individuals at a guest house in Kandahar, Afghanistan, to swear allegiance to bin Laden. On the evening of Sept. 11, 2001, after the terrorist attacks on the United States, bin Laden summoned Abu Ghaith and asked for his assistance. He agreed to provide it.

On the morning of Sept. 12, 2001, Abu Ghaith appeared with bin Laden and Zawahiri, and spoke on behalf of al-Qaida, warning the United States and its allies that "[a] great army is gathering against you" and called upon "the nation of Islam" to do battle against "the Jews, the Christians and the Americans," the court document says.

Also, after the September 11, 2001 terrorist attacks, Abu Ghaith delivered a speech in which he addressed the then-U.S. Secretary of State and warned that "the storms shall not stop, especially the Airplanes Storm," and advised Muslims, children, and opponents of the United States "not to board any aircraft and not to live in high rises."

Abu Ghaith arranged to be, and was, successfully smuggled from Afghanistan into Iran in 2002, where he spent most of the decade, U.S. officials said.

Even as government officials applauded the arrest of Abu Ghaith, his transport to the United States stirred controversy among lawmakers who were apparently caught by surprise by the news.

"We believe the administration's decision here to bring this person to New York City, if that's what's happened, without letting Congress know is a very bad precedent to set," said Sen. Lindsey Graham, R-S.C., who held a press conference with Sen. Kelly Ayotte, R-N.H.

"And when we find somebody like this, this close to bin Laden and the senior al-Qaida leadership, the last thing in the world we want to do, in my opinion, is put them in civilian court. This man should be in Guantanamo Bay," Ayotte said.

"So we're putting the administration on notice," said Graham. "We think that sneaking this guy into the country, clearly going around the intent of Congress when it comes to enemy combatants, will be challenged."

Earlier, in an interview on MSNBC, House Intelligence Chair Mike Rogers, R-Mich., strongly criticized the administration for bringing Abu Ghaith to the United States.

Rogers, a former FBI agent, said that Mirandizing a top al-Qaida suspect and bringing him to the United States for trial creates a host of problems — instead of sending him to the facility at Guantanamo Bay, Cuba, which was built to handle high value prisoners.

"Al-Qaida leaders captured on the battlefield should not be brought to the United States to stand trial," Rogers said. "We should treat enemy combatants like the enemy. The U.S. court system is not the appropriate venue."

The Obama administration has been trying to clear out Guantanamo and not bring any new prisoners there.

Sen. Charles Schumer, D-N.Y., said it's fine with him if Abu Ghaith is put on trial in New York because key state and city officials had been consulted in advance, unlike in the case of terror suspect Khalid Sheikh Mohammed.

"Unlike with KSM, Kelly and others had been consulted ahead of time about this and they gave the green light to do it. As you know, (Police Commissioner) Ray Kelly, Mayor (Michael) Bloomberg and I opposed the trial of (Mohammed) in New York and we successfully made sure that didn't happen," said Schumer. "On issues like this, I defer to Commissioner Kelly, and I think the mayor does as well. And he thinks it's OK to do it here, and I'll go by that," Schumer said.

Jordanian sources confirmed that Abu Ghaith was sent by Turkey via Jordan to Kuwait, and intercepted in Jordan and brought to the U.S.

According to the officials, who spoke on condition of anonymity, Turkish officials captured Abu Ghaith in the capital Ankara, where a court ruled he had entered the country illegally with a fake passport. The Turkish government then ostensibly deported Abu Ghaith to his birthplace Kuwait, but arranged for him to transit through Jordan where he was ultimately taken into custody by U.S. law enforcement, the officials said.

U.S. officials told NBC that prior to his interception in Turkey, Abu Ghaith, who dropped out of sight after 2002, had spent most of a decade in Iran.

"Nobody's heard a peep. Some people thought he was being held prisoner in Iran, others thought he might be dead," said Evan Kohlmann, an American counter-terrorism analyst for NBC News.

This President graduated from an ivy league school with more than just a C-. Stop bashing and applaud our President, FBI, CIA and Jordanian counterparts. Yes, he could have said "could cure AIDS", heart disease, or any of the other "killer" diseases society is faced with, and the point would have been the same. It is actually the GOP that has cut federal funding for research on "cures" for all of these diseases. It is amazing that this story is actually about a GOP Representative praising the president, the CIA, and the FBI, along with a foreign government. Maybe we are finally getting some of the right-wing to see that our administration IS doing something positive about our security.

Last time i checked, Obama withdrew troops to end the war and wasn't seeking to catch anyone. I don't give Obama praise for the capture, the credit belongs solely to the actual person/persons who physically apprehended the dirtbag, NOT the government who sleeps evernight in their bed dreaming of the capture.

I didn't see anyone from al-Qaeda captured or killed during the last 7 years of Bush's administration. Bush said he wasn't that interested in capturing Bin Laden. Hell, the Bin Ladens were old family friends.

It could be Bush was intentionally leaving Osama alone. 9/11 was an inside job.

During the first 4 years Bush took over 230 days vacation, total for Obama in all of his time in office = 74, the reason this country was attacked on 9/11 was that Bush was asleep in Texas when the intel briefing was held.

Sorry for reposting, this is where I wanted comment to go....Interesting, they can capture him in another country, but kill US citizens by drones in another country, forgoing their 5th Amendment rights of due process, based on a supposition that they were going to attack the US, instead of capturing them! Again, I say that they weren't killed in an actual attack on us or our troops! Remember, one of them was only 16 years old!     FYI, be cautious of what your being spoon fed by the media because it was reported on NPR last night that the DOW Jones Industrial Average is an extremely misleading indicator of how the the market is doing.

    For one it is only comprised of a few of the biggest companies, a small segment of the entire market. Secondly, it is the only one that is not adjusted for inflation; hence, when inflation has been factored in the DOW's value is actually 10% lower than presently reported, it's real valued is roughly where it is was about two years ago.

    You liberally chiming the good news that its at an "ALL TIME HIGH" is like saying you just got a big raise and bragging about it as being a good thing; when in reality it puts you at the same level of income you were making two years ago! Smoke and mirrors buddy, enjoy your raise!

    Think about this: 1993 was a wake-up call to all America, especially for everyone in government, including George Bush who was a Governer in Texas. But no, George Bush (Jr.) just kept sleeping through the wake-up call by hitting the re-set button or so it seemed. (Perhaps Cheney kept those intelligence documents about a tentative attack off Georgies desk, the same way he put the false reports about weapons of mass destruction on his desk.) In a way I feel sorry for George, he really is a likeable guy who was groomed by his party to be nothing more than a "figurehead", meanwhile Cheney and his henchmen were pulling the strings. I will never forget George W's delayed reaction caught on camera when one of his aids whispered in his ear "The U.S. is under attack" or something like that. He just sat there with a dumb-founded look on his face for several minutes. Everyone expected him to immediately excuse himself from the classroom and attend to more pressing business. But no, he just sat there. Scary. Laura Bush did more for the country the following day with her address to the country that everything was under control and be calm and carry on. Laura Bush made a better first lady than George did president.

    There is good and bad in both parties. However, I must say that the Republican party is not in touch with the middleclass in this country. They used to be. Now it's set agenda is to promote big business and those who are in the upper 2%, wealthy Americans. They have corrupted their message to those in the middleclass who's families have been Republicans for generations. They have a slick new way to insight civil unrest with their new tool "The Tea Party Movement" which is only a repackaging of the new Republican agenda to sound like it is something good for the common folks when actually it is not. The absurdity is that a majority of the common folk think that the Republican Party is talking about them when they use the term "middleclass" when they are not. When you listen carefully to what the Romney's, Ryans, Gingrich, etc. define as middleclass income, it is anyone who earns $250,000.00. I suppose for millionaire's this is the definition of being middleclass in America. That would make the 42% of us who consider ourselves as middleclass as the working poor averaging between $50 -$60 thousand combined income.

    Many on these comment venues are haters of the Democratic Party and Obama. Meanwhile they are dependent on the many government programs that provide medical, food and housing subsidies that the Democratic party provides. So many times we see Republican Governers accepting state aid for their people and all the other breaks since the financial crisis that PBO has made possible and yet bight the very arm and hand that feeds them. This is a paradox as one cannot be for and against something at the same time.

    If you like the Republican party then practice what they preach and do not accept any free government handouts. See how well you do with less government in your life. There is an old proverb, be careful what you ask for. If you want the Democrats out and the Republican's in, then my fellow "real" American middleclass and some poor, be prepared for what you are going to get. I can assure you that if you think things are bad for you now, they are only going to get worse.

    The 1993 WTC attack occurred on February 26th just one month after Clinton took off without any previous warnings. The 2001 attack occurred on Sep. 11th nearly 8 months after Bush took office with plenty of warnings months before the event. But you know what?? Clinton NEVER tried to blame the previous administration for the 1993 attack and I have never heard anyone say Obama would not accept responsible for the attack on Benghazi but Bush people have always tried to pin the blame of 9/11 on Clinton and still blame the recession on Obama. When will you right wing fanatics accept responsible for your actions.

    Last time i checked, Obama withdrew troops to end the war and wasn't seeking to catch anyone. I don't give Obama praise for the capture, the credit belongs solely to the actual person/persons who physically apprehended the dirtbag, NOT the government who sleeps evernight in their bed dreaming of the capture.

Our president is the Commander in Chief of the Armed Forces and responsible for the death of Osama Bin Laden and other members of Al Qaeda, as well as those military failures the "right wingers" are so eager to attribute him. Presidents don't shoot bullets, they are the top person in our military. They take blame as well as responsibility. Live with the fact and acknowledge the pros and cons before you comment here, otherwise you're calling attention to yourself.

      Killing OBL and many others involved in 9-11, as well as this and other characters in trial, never meant to be the end of Al-Qaeda. It was something we had to do, that's all.

      G.W. Bush's "declaration of war" on Al Qaeda wasn't naive, but plain stupid. You can't fight idealism that feeds on hate and frustration surrounding the movement, through conventional warfare, but rather through education and policy changes.

      Now we're just one step closer to "avenge" our U.S. attack. But we're long ways from eliminating the risks of a new one, as well as easing the interference with our personal rights and privacy.

        You are correct that the DOW is only a partial picture. So is just adjusting for inflation.

        A better picture is adjusting for both inflation and dividends since they both affect the overall return on a DOW investment. It's called the Average Total Return (DJITR). An inflation adjusted $100 stock with a $2 dividend is worth less than a inflation adjusted $98 stock with a $5 dividend.

          Today Americans have been raped of over 40% of their wealth. The most amazing part of all this is that there was government malfeasance for decades and despite regulations and deregulations no one has been found responsible. The initial feel-good Community Reinvestment Act began a 30 year bubble that will be analyzed over and over by economists and other authorities. Yes, the same people who denied its existence and never saw the bubble growing will now decide what happened.

The speech was going to say "mission accomplished" but Rumsfeld removed it when reviewing the speech. Bush did say it, however, a month later in a speech to the troops in Afghanistan at Camp As Sayliyah on June 5, 2003. The speech he did give on the aircraft carrier said that the major combat operations in Iraq were over and we had prevailed. However, the most deaths occurred after the speech as guerrilla warfare began. They were horribly premature to determine we had accomplished anything!

I'm sure you meant that the percentage was the same, not the actual dollars. Because under Eisenhower, my father in the Navy took a paycut (yes it happened) and received approximately $300.00 per month as a second class. Our house payment was $61.00 per month. Things are more expensive now and I don't recall ever during the 50's the US have a Trillion dollar budget.

                                                                I don't think our President knew anything about this man until he was captured. Which is how it works. No President is a micro-manager. But to praise him for helping in the capture is a little bit odd, in my opinion. Especially coming from a Republican. But then, I suspect Peter King wants to make sure that the sequester issue doesn't affect the aid to the Super Sandy Storm victims in New York.

                                                                Amazing how a disaster can bring Americans together. Now if we could just work together on getting a budget out, reviving the economy (and yes it's still in the doldrums), and get people back to work, which should bring in the necessary tax dollars to offset future sequestrations. Remember, people, the sequestration is a ten year deal. Every year for the next 9 years, this is going to happen, unless the politicians begin working together.

                                                                My guess is President Obama would have to give approval at some point, because we needed the co-operation of other sovereign countries. I'm not clear on the international law on this (it's been a long time since I took that course, and much has changed since then), but I doubt very much that the Attorney General, SecState, or SecDef could have given that level of approval. And when you are dealing with sovereign countries, you need to work at least that far up the chain of command.

                                                                So is the issue that Rep, Peter King, R-NY, gave the credit to the president, or that Rep. King didn't attribute it to the final fruition of President Bush's plans laid all those years ago?

                                                                  Congratulations on the children and their success and hopefully happiness. I too am from the South. Southwest is more accurate. My two both graduated from a University and one is a 4th grade teacher and the other one has been working in finance but will be opening a bicycle shop later this year.

                                                                        To say we captured him is misleading. I'm sure the scenario was orchestrated by Turkey Jordan and the US to move him to a place that we could take custody with the min. amount of legal red tape. I would be willing to bet Turkey recognized who they had and alerted the US. Congrats to their secret service ,HE might have been handed over to Turkey by Iran as a back door gesture ,the US knowing about it all along. Who knows .......unless Biden gets a case of motor mouth.
