    Immigration decision could make it easier for foreign 'fusion' bands to play in US

    The band of young musicians from Buenos Aires, who blend Klezmer music – traditional instrumental music of Eastern European Jews – with Argentine tango and folk, were denied entry in November 2009 by U.S. immigration officials. A U.S. Citizenship and Immigration Services director recommended against issuing the group a so-called P-3 a visa to perform at a “Fiesta Hanukkah” concert in Los Angeles, saying there was no proof the group’s act was “culturally unique.”

    After public blowback, an appeals board re-examined the case and reversed the decision – but by then Hanukkah had passed and Orquesta Kef never got to play in L.A.


    This week, Citizenship and Immigration Services announced it was officially clarifying its definition of “culturally unique” to specify that it “is not limited to traditional art forms, but may include artistic expression that is deemed to be a hybrid or fusion of more than one culture or region.”

    The new definition will apply to reviews of future applications for P-3 visas from foreign performing artists and entertainers.

    “It was something that needed to have a more fine-tuned definition,” said immigration services spokeswoman Sharon Rummery. “It’s going to make it easier for us to adjudicate cases like these in the future."

    People who want to perform in the U.S. typically need one of the following: a P-1 visa, issued to internationally recognized athletes, artists and entertainers; a P-2, for artists or entertainers in a reciprocal exchange program; a P-3 visa, issued to entertainers participating in a culturally unique program; or an O-1, known as the “genius” visa, for individuals with extraordinary ability in the arts, athletics, education or sciences (NBA star Dirk Nowitski of Germany, for example, has an O-1).

    In its original P-3 denial, an immigration official concluded of Orquesta Kef:

    “The evidence repeatedly suggests that the group performs a hybrid or fusion style of music, incorporating musical styles from other cultures and regions. A hybrid or fusion style of music cannot be considered culturally unique to one particular country, nation, society, class, ethnicity, religion, tribe, or other group of persons.”

    The band had been booked by the Skirball Cultural Center, a Jewish cultural institution in Los Angeles, to perform at its annual Hanukkah holiday concert. In the visa application, Skirball included a short biography of the band, describing the ensemble’s  “unique musical style” as “based on the millenary force of tradition and the powerful emotion of the Jewish culture, mixed in with Latin American sounds.”

    Skirball also provided letters from music experts who testified to the group’s unique sound.

     “How more culturally specific can you get than Jewish music of Latin America?" Jordan Peimer, Skirball’s vice president and director of programs, thought at the time.

    The visa denial was the topic of several scathing columns, including a blog post on Foreign Policy magazine’s website sarcastically titled “Keeping America safe from Latin Klezmer bands.”

    Peimer, who said the initial denial was “a huge missed opportunity,” called the latest decision “a vindication for the band … and also a vindication for the American people.” 

    “It says our government works,” he told msnbc.com on Wednesday.

    Alejandro Filippa, a New York immigration attorney who specializes in artist visa applications, said the immigration agency’s clarification of the definition of “culturally unique” was a positive step in a world of increasingly diverse and interdependent cultures.

    “The door is now more open for an entire new wave of artists to perform in the United States,” Filippa said in an email to msnbc.com. “Unfortunately, the fact this application was initially denied is indicative of the cultural ignorance of some USCIS officers in adjudicating cases that are more reflective of the modern, diverse international community we now live in.”

    As for when Orquesta Kef might finally play in the U.S., Peimer says he hopes to book the band for a future Hanukkah concert.

    Thousands sing song of peace to protest Norway killer Breivik

    Reuters reports — Up to 40,000 Norwegians staged an emotionally-charged sing-along in Oslo on Thursday near the court house where Anders Behring Breivik is on trial for the murder of 77 people in a protest organizers said showed he had not broken their tolerant society.

    "It's we who win," said guitar-strumming folk singer Lillebjoern Nilsen as he led the mass sing-along and watched the crowd sway gently in the rain. Many held roses above their heads, and some wept.

    Berlusconi accused of plagiarism by Italian rapper

    Silvio Berlusconi, the former Italian prime minister who resigned in November amid an acute economic crisis and several sex scandals, has been accused of plagiarizing an Italian rapper in the new anthem for his political party People of Freedom, The Telegraph reports.

    Called "People of Liberty," the song includes the line "We are the people who hope and who fight, who believe in the dream of liberty!," according to the British paper.


    But Italian rap artist J-Ax, whose real name is Alessandro Aleotti, claims Berlusconi's song is similar to one of his own -- released in 2002 -- called "People who hope" ("Gente che spera").

    On his official Twitter account, J-Ax threatened to file a complaint against Berlusconi for plagiarism. "Tomorrow I will denounce Berlusconi," the artist tweeted.

    Berlusconi, 75, is no stranger to the music world. Late last year, Berlusconi released “True Love,” his latest CD of love songs. The CD is the fourth record he has produced with Neapolitan singer and guitar player Mariano Apicella, who since 2003 has been considered the personal minstrel of Berlusconi.

    While he was a young student, Berlusconi paid for his studies by working as a crooner on cruise ships.

    Rocking out to hip-hop in the new Myanmar

She was most recently on assignment in Yangon, Myanmar’s commercial capital, in early December for U.S. Secretary of State Hillary Clinton’s meeting with pro-democracy icon Aung San Suu Kyi.

    YANGON, Myanmar – A thumping rock and hip hop beat, entranced teenagers clutching beer cans, hundreds of people smiling happily – it sure wasn't the Myanmar I am used to.

    I've had plenty of memorable experiences in Myanmar, most of them unpleasant. I've been kicked out of the country by officials not once, but twice.



    In 2007, when journalists were forbidden from covering the so-called "Saffron Uprising," I posed as a tourist to get into the country and played cat-and-mouse with the security forces to grab some footage when escalating political protests, initially led by monks, were crushed by the military. I watched soldiers beat cowering Burmese men and women with batons on the streets of the capital. It was an exceptionally dangerous time: a Japanese journalist was among those killed. 
     
    The following year I was back again to cover the devastation caused by Cyclone Nargis.  I saw people who literally lost everything – I remember one man who was clutching photographs of his wife and children to help officials find their corpses. Reporters were banned from the whole cyclone-hit area, so again we had to film in secret. Eventually our team was spotted, and police later tracked me down to a hotel in the capital and threw me out of the country.

     

    During all of my previous trips, most people I met were terrified to talk, fearing they could be jailed just for speaking to a journalist. Even the guide who took me to the barricaded house where pro-democracy leader Aung San Suu Kyi was imprisoned begged me not to take photographs, saying it could put him in danger.

    So it was wonderful to be able to move freely around Yangon during my last visit, and to find optimistic people unafraid to talk. That alone showed me how profoundly things have changed already.
     
    This time I was there on Dec. 2, 2011,  the same day U.S. Secretary of State Hillary Clinton met with Suu Kyi. I went to a huge rock concert, and I had a lot of fun.

    Rocking out of a rut
    Myanmar has stagnated for decades under the oppressive rule of a paranoid military dictatorship, but over the past year the country has suddenly started to make progress toward greater democracy and freedom of expression – and more tolerance of rock and hip hop.

    So I found myself at a nearly-sold-out concert at an indoor stadium in Yangon. Burmese stars belted out rock and hip hop tunes to an audience of girls in tight skirts and young men in skinny jeans, instead of the traditional sarongs usually worn in the country.

    The music was full of energy, and got me moving, but there was little boisterous enthusiasm and dancing among the audience – most stayed seated, tapping their feet and nodding their heads to the music.

    They were mostly rich kids, teenagers who arrived at the stadium in expensive cars while poor children in tattered clothes collected garbage around the stadium.

    “Only rich or middle class people can afford to buy a ticket as you have to spend at least 50 kyats ($7),” a Burmese friend told me. That would be cheap for a concert in most countries, but Myanmar remains mired in poverty and most people earn just a few dollars a day.

    There were still plenty of reminders of the old repressive Myanmar: the atmosphere at the concert was not helped by the presence of several stern-looking armed guards.

    Singing for change
    Backstage the celebrity musicians were hanging out before the concert started, and I met the hip hop group ACID in their room. Their first album, also Myanmar’s first hip hop album, was the country’s best seller in 2000.  But their non-traditional style, lack of deference for authority and controversial lyrics about the hardships of life in Myanmar eventually got them in trouble.

     “Our music was new to people. The government doesn’t like us because we did not follow the traditional style,” said Anegga, a 32-year-old ACID band member who goes by one name.

    Two of the band's members were arrested in 2008 for allegedly illegal political activities. One of them, Zayar Thaw, 32, was dressed in shorts, a tee-shirt, a baseball cap and his arms were covered with tattoos – not exactly the traditional Myanmar ideal of a quiet, well-behaved young man.  
     
    He was released from prison in May, and told me he still has to watch his words. “I have to be careful about saying things now, Big Brother is watching.” 

    But now, the band is back together and ACID is performing again. They are among more than 50 musicians and singers who have pledged their support for the election campaign of Suu Kyi, who has been released after years of house arrest and is now running for a seat in parliament. 

    Suu Kyi's musical supporters are producing a special album, with songs designed to raise awareness about politics and encourage people to stand up for their rights. One of the songs contributed by ACID asks: “How can I talk, How can I see, If you close my eyes and ears?”

    The musicians hope their songs can help push the boundaries and educate people in their country after 49 years of censorship and military rule.

    “Everything for Aung San Suu Kyi, we love to do it for her. We love her,” said female pop singer Than That Win.

    After elections in November 2010, which were widely condemned as rigged, Myanmar's ruling generals exchanged their uniforms for civilian suits – but few expected much to change.

    Then beginning in October of this year, the government introduced a series of dizzying changes: The new government led by a former general, Thein Sein, eased censorship, released political prisoners, introduced a limited right to strike and protest, and started a dialogue with the Suu Kyi.

    The United States has shown its support for the political reforms – Clinton was in town when the concert was held, to see the progress for herself.

    Like many Burmese, the musicians worry that the recent changes could be a false dawn. They are optimistic, but still wary.

     “This is the beginning of change in the country," Anegga told me. "We hope nobody will be arrested this time.”

    Amy Winehouse death verdict could be unlawful

    Story updated 1:15 p.m. ET: The local authority, Camden Council, said it was confident Reid "had made an error in good faith" when he appointed his wife, but said the matter was being investigated by Britain's Office for Judicial Complaints.

    Story published 11:30 a.m. ET: The coroner who oversaw the inquest into the death of singer Amy Winehouse has resigned after her qualifications were questioned, officials in Britain said on Wednesday.

    Suzanne Greenaway ruled in October that the 27-year-old soul singer had died from accidental alcohol poisoning.


    However, she resigned after authorities learned she had not been a registered U.K. lawyer for five years as required. It means the verdict in Winehouse's case and 11 others carried out by Greenaway could be subject to a High Court challenge.

    Winehouse's relatives said they were still absorbing the implications of the news.

    Greenaway had been appointed an assistant deputy coroner in London by her husband, Coroner Andrew Reid. She had practiced law for a decade in her native Australia.

    Reid said Wednesday he was "confident that all of the inquests handled were done so correctly" — but offered to hold inquests over again if the families of the deceased wanted it. Greenaway had been in the job since 2009.

    Winehouse's family said it had not yet decided what to do.

    In a statement, the family said it was "taking advice on the implications of this and will decide if any further discussion with the authorities is needed."

    The Sun newspaper, which broke the story, said the dozens of verdicts given by Greenaway would only be overturned if they were challenged in Britain's High Court.

    A security guard found Winehouse dead in bed on July 23 at her home in the Camden district of north London. The singer, known for her distinctive beehive hairdos and multiple Grammy-winning album "Back to Black," had battled drug and alcohol addiction for years.

    The inquest heard evidence from a pathologist, Winehouse's doctor, the security guard who found her and a detective who described seeing three empty vodka bottles in her bedroom. It appears unlikely that a second inquest would produce a different conclusion about how she died. 
     
    The full statement issued by Reid on Wednesday was reported in north London newspaper, the Camden New Journal. It read: "I appointed my wife as an assistant deputy coroner as I believed at the time that her experience as a solicitor and barrister in Australia satisfied the requirements of the post. In November of last year it became apparent that I had made an error in the appointment process and I accepted her resignation.

    "While I am confident that all of the inquests handled were done so correctly, I apologise if this matter causes distress to the families and friends of the deceased. I will be writing to the families affected to personally apologise and offer for their cases to reheard if requested."

    Although the singer was adored by fans worldwide for her unique voice and style, praise for her singing was often eclipsed by lurid headlines about her destructive relationships and erratic behavior. Winehouse herself turned to her tumultuous life and personal demons for material, resulting in hit songs such as "Rehab" and "Love Is a Losing Game."

    Recreating Afghanistan's soundtrack, one young musician at a time

    The yellow rickety bus pulls up at the big iron gates. Enthusiastic students, in the midst of a harsh winter, arrive quickly. Others soon appear by foot or pushbike, and they all line up for their daily security pat-down to enter school. But this isn’t just any school, this is Afghanistan’s revived institution for the education of young Afghan musicians.

    Ahmad Sarmast, 49, the founder of the Afghanistan National Institute of Music, is an Afghan national from Australia who lives in Kabul most of the year.

    “I identified the need to establish a dedicated music college, where the most disadvantaged kids of Afghan society can get their general education and specialist training in music that will guarantee them a bright future,”  he said.

    The jovial father of two comes from a family with a rich musical pedigree -- his father was the late, well-known Afghan musician Ustad Sarmast. The younger Sarmast wanted to use that reputation and his qualifications to help his native country. His vision for the school took root in 2006 after he earned his Ph.D. in music at Monash University in Melbourne.


    Several years later, the school is thriving, and music teachers come from all over the world to instruct the students.  Instrument tuition ranges from drums, piano and violin to traditional string instruments such as the Sarod and Rubab.

    One of the students, who goes by the name Sapna, is an orphan from Jalalabad who is believed to be 9 years old. Now, she says, she can envision a future for herself.

     “When they did [the] entrance exam I chose piano -- and I also like violin,” she said.  “I want to be famous all over the world. All kids should learn these things.”

    Afghan culture had always provided a rich tapestry of music tradition and history, but when the Taliban captured power in the 1990s, they forcibly banned music in Afghanistan. Musicians suffered discrimination – in many areas only chanting was permitted. Post-Taliban, Sarmast witnessed a bleak and discouraging picture of the music scene.

    “When I saw that very grave picture – I decided my country needs me and I have to return back to Afghanistan,” Sarmast said. “That was the major factor for my decision.”

    The school now has 140 students with 50 percent of the school enrollment each year reserved for the disadvantaged kids from Afghan society: orphans, street vendors and girls. Sarmast said his school is committed to not only promote music, but to rebuild ruined lives and to empower the women of Afghanistan to practice and listen to music.

    “While we are preserving or reserving 50 percent of the places for the most disadvantaged group of Afghan society, the other 50 percent are the most talented kids of Afghanistan,” he said.  "If they’ve got the talents, we do everything to have them here.”

    People in the community are very supportive of the promotion of music, and music education, Sarmast said. “ everyone is trying to get their kids here so that says a lot.”

    One man who shares the same vision as Sarmast is popular music teacher William Harvey from Indianapolis, Ind. who has been teaching at the school since March 2010.  Harvey said he believes in the power of music to transcend cultural barriers. “It’s a positive experience that transforms the relationship between the countries one person at a time,” he said.

    “When I first came here they could only play ‘Love Story’, or ‘Godfather’, now I have two top students learning Bach’s concerto for two violins,” he added.

    Harvey said the students are exceptional and unusual. Teaching the Afghans differs from teaching students in the U.S. because the students often come from very difficult backgrounds. 

    “It’s also possible in the U.S., but the social mechanism to support them isn’t always there. If a child is being beaten constantly by her father there is no child protective services here," Harvey said. "We do have children that used to be selling chewing gum on the street but thanks to the sponsorship program initiated by Dr. Sarmast, now they are studying violin with me.”

    Harvey recalled a student of his, a girl who was forced to work on the streets, begging for small change to support her family. Her father had been paralyzed after being beaten with an electric cable during the Taliban’s reign.

    "Instead of working on the streets this girl is now studying violin -- and I believe that she has a good shot at a career, not just in Afghanistan but perhaps internationally given the talent that she has shown.”

    Harvey said he believes cultural diplomacy is essential for the United States' relationship with Afghanistan. "I remember conducting the orchestra for President Karzai, four times now, and one of those times someone who was a member of the previous government came up to me and shook my hand and I thought, ‘Wow – this is amazing,'” he said. "Because you know under the government that he served music was banned. And here he is shaking hands with an American who just conducted Afghan children – boys and girls playing Afghan music.”

    Sarmast is confident that in 10 years there will be at least three other music schools in Afghanistan.  “That’s my vision and I’m dedicated to establishing three more. But on the other end I see, and it’s clearly in front of my eyes, the first symphony orchestra of Afghanistan completed by the graduates of ANIM!” he said excitedly. 

    "When they play I can see the happiness in their faces – and how much they are enjoying it,” he said. “On Sunday I was in the orchestra room and they were rehearsing I couldn’t control my tears when I came out of the studio.”
